Just so you know, if you attempt to list it again, you could be banned forever on eBay. Sell it somewhere else.

@Anonymous
If you keep relisting it, you won't have to worry about it, they'll boot you off of Ebay.

RX/Prescription products are not allowed to be sold on eBay.
Just because other sellers haven't gotten caught.........yet, doesn't mean it's ok.
Do NOT relist and try to sell again. You will be banned from eBay for good.

@Anonymous
Here in the USA we call that practicing medicine without a license.
Follow others advice, do not relist.

As others have said, do NOT relist or you risk being permanently banned from selling on eBay. Find some place else to sell it, and sell something else on eBay.
As to other listings for shiljit, I did not look at them but I imagine that those sellers do not make any medical claims for the product. They sell it as a supplement, without claiming it ameliorates or cures any medical condition, physical or mental. They use the term "serving" instead of "dose." And so on.
Or. maybe they are in violation of policy but have not yet been caught. That happens all the time. The apt analogy is that of the hundreds os people speeding on any one stretch of highway, only a few get caught by the troopers.

I don't know what the heck shilajit is and am thankful eBay and the FDA are protecting us from it. Try selling it just to your own countryman, the FDA will not care.

@Anonymous
Please tell me that you don't currently have it listed AGAIN with 3 different versions of the spelling of the name in the title!
Good grief!

BTW, changing your ID to stay under the radar isn't going to protect you. It's the same account!

They sure did relist it.

I too had never heard if shilajit but I did some quick 10 seconds of due diligence and found this from a government website : "Shilajit is a potent and very safe dietary supplement". As others noted, as long as the OP is not making any medical claims in the description then this is a product that Ebay need not protect us from.

It also appears to be a sticky resin like substance that occurs from rotting plants. No thank you.

Question. What is Shilajit?
09-20-2022 11:27 AM
@Anonymous if you go to the FDA website and type Shilajit in the search bar, you will get several results. The first was this letter sent by the FDA to a someone selling Shilajit, It explains, very clearly, all the reasons why it may not be sold, and exactly what wording and claims contribute to its status or restrictions. The FDA says sellers can't claim health benefits or that it can treat medical conditions and ebay is just complying with the FDA's regulations.
"This letter is to advise you that the U.S. Food and Drug Administration (FDA) reviewed your websites at https://naturalshilajit.com and https://organicagsolutions.org in November 2017 and has found that you take orders there for Shilajit Resin, NutriHoney, and Bulk Shilajit. Various claims and statements made on your website and/or in other labeling establish that these products are drugs as defined in 21 U.S.C. § 321(g)(1)(B) because they are intended for the treatment, cure, mitigation, or prevention of disease. For example, your website recommends or suggests the use of Shilajit Resin, NutriHoney, and Bulk Shilajit to treat or prevent cancer, diabetes, depression, high blood pressure and kidney stones. As explained further below, the introduction of these products into interstate commerce for such uses violates the Federal Food, Drug, and Cosmetic Act.
These products are also new drugs as defined under 21 U.S.C. § 321(p) because they are not generally recognized as safe and effective for the uses recommended or suggested in their labeling. Before a new drug may be marketed or otherwise introduced into interstate commerce, it must be approved by FDA on the basis of scientific data demonstrating that the drug is safe and effective under the conditions of use in its labeling. See 21 U.S.C. §§ 355(a) and 331(d). Your drug products do not have FDA-approved applications as required by 21 U.S.C. § 355.
We advise you to review all materials through which you communicate to consumers the intended uses of your products, and to either submit a new drug application (NDA) for products intended for use in treating, curing, mitigating, diagnosing, or preventing a disease or, alternatively, remove all statements indicating that your products are intended for such uses. This would include reviewing your websites, product labels, catalogs, brochures, flyers, package inserts, audio and video, e-commerce and social media accounts you operate (e.g., Amazon, eBay, Facebook and Twitter accounts), as well as any other promotional materials, and removing product claims, consumer testimonials, metatags, and anything else that states or implies that your products are useful in treating, curing, mitigating, diagnosing, or preventing diseases.
Within 30 calendar days of the date of this letter, please correct the violations described in this letter and notify FDA, via electronic mail at FDAadvisory@fda.hhs.gov or via mail to ORA Health Fraud, 12420 Parklawn Drive, #4041, Rockville, MD 20857, that the violations have been corrected. Include the Online Advisory Letter Reference number (located in the upper right portion of this letter) in all your communications to FDA regarding this matter.
After 30 days from the date of this letter, if your website or other labeling continue to demonstrate that your products are intended to treat, cure, mitigate, or prevent diseases, the name of your firm and this letter will be posted on the FDA webpage for unapproved new drugs illegally marketed for serious diseases.
This letter is not intended to be an all-inclusive review of your website(s) or a list of all violations of law that exist in connection with your products, your website(s) and other product labeling, or at your facilities. FDA expects you to take the necessary steps to ensure that all your products comply with the laws and regulations enforced by FDA.
Sincerely,
Health Fraud Team
Office of Enforcement and Import Operations
Office of Regulatory Affairs
U.S. Food and Drug Administration"
I hope this helps explain the restrictions.
