How is a buyer able to open a return case before they even get the item?

I just got a buyer requesting to return an item the buyer didn't even receive in the mail yet.  Reason Doesn't fit and then I don't need got another one.  

Called ebay they said I need to call back when buyer receives the item.

Well seems to be there should be a way for ebay to stop a buyer from opening a request until item is received.

Returns are not counted against you; however, eBay does keep track of how many you have.

Until they change it so that they are counted against you. Retroactively, of course.
