My legitimate DVDs are removed because of report, not through VeRO. Someone reported them and eBay removed them incorrectly without careful investigation. And more importantly, they don't accept any appeal!

 

I've been selling these collectors editions for about one year and have no problem. They are legitimate DVDs, by searching "bluray steelbook" + brand name such as "blufans, hdzeta, filmarena, weet, novamedia", you can find a lot of them on eBay.

 

I spent hours writing a letter to eBay but got no response. I've been contacting eBay since the first removal. During the three week's communication, they keep repeating the same thing and can be summarized to these:

 

Your items are against policy because they are counterfeit.

We don't care your proof, we don't accept any appeal.

 

It's not a single mistake, 7 of my listings are removed, ALL of they are legitimate and ALL of them are still selling on eBay by many other sellers with great feedback.

 

Any advice?

 

The listings are removed so I can't post their link. But the key words for same listings are:

Guardians of the Galaxy Weet

Black Panther Weet

Jurassic World Blufans

Ghost in the Shell Blufans

 

Here is the letter I wrote to them about my removed listings "Guardians of the Galaxy Weet" and "Ghost in the Shell Blufans". I believe anyone who read this letter can find that these DVDs are ligitimate.

Dear eBay team,

 

I received email recently saying that my listings [223485620274, 223498350259, 223564237146] are removed because of “copyright violation – unauthorized items”

 

I am sure that it’s competitors reporting with selfish intention and mislead you to make this incorrect decision. Please also inform me if this is a VeRO take down. If it is a VeRO take down, I would start the counter-notice procedure.

 

Your customer service representative Scarlett has passed my request to you, but your answer is “First sale doctrine doesn’t apply if the goods are illegitimate.” Therefore, I spent hours writing this article, to tell you all about these removed listings.

 

The listings you removed recently are authentic, authorized copies of Blu-ray DVDs. They are collector’s edition, they has slipcover with incredible texture, steelbook with beautiful art, and Blu-ray DVD disks inside. ALL of them are approved by the movie’s rights owner.

 

There are thousands of people from USA, UK, Germany, France, South Korea, Czech, Hong Kong, China buying and selling these sorts of collector’s edition Blu-ray DVD. These Blu-ray DVDs are made by by the copyright owner like Sony Pictures and Walt Disney, shipped to countries all over the world, officially imported by authorized publisher and distributors, sold to retailers like Best Buy, Target, Amazon, and other Premium Brand such as Blufans, HDZeta, Novamedia, Kimchidvd, Filmarena, WeET, etc. For normal editions of amaray case, the disks are packed into the cases by publisher or distributor. For collector’s editions like steelbook and digipak, the disks are packed by these retailers and brand. Then the customers, including me, bought these copies.

 

By searching the brand name + bluray steelbook, for example, “Bestbuy Bluray Steelbook”, “BLUFANS Bluray Steelbook”, you can find thousands of results. By searching with movie name + bluray steelbook, for example, “Jurassic World Bluray Steelbook”, you would find thousands of results as well. By searching with movie name + brand name + bluray steelbook, you can get a more specific result. This is the world of movie collectors.

 

Now, if you type the movie name + brand name + bluray steelbook for my removed listing, for example “Guardians of the Galaxy WeET”, you would find that many other sellers are selling the same Blu-ray DVD. Most of them are individual sellers, and can’t possibily get authorization from the copyright owner. I bet most of them don’t even know who the copyright owner is.

 

But, they are still selling them without any problem, because eBay policy has clearly stated in

that “Under copyright laws, the owner of a particular, authorized copy of a copyrighted work is generally entitled to resell the particularcopy they own. For example, if you buy a DVD movie, you're allowed to resell that particular DVD.” The sellers of DVDs don’t need permission or authorization from the copyright owner, don’t need to know who the copyright owner is. They only need to know whether that copy in hand is authentic or not.

 

To find out whether a Blu-ray DVD is authentic, there are several clues:

First, what’s the price? Bootlegs or unauthorized Bluray DVDs always have much lower price. Normally an authentic Blu-ray DVD is $10-20, and 4K UHD Blu-ray DVD is $15-30. Price for collector’s editions such as Steelbook can vary. Bootlegs always have low price because of their poor quality.

 

Second, check the UPC/ISBN. Type the UPC/ISBN into the local search engine (google.com for USA, naver.com for South Korea, baidu.com for China, etc), or search in local government’s copyright database.

 

Third, check on blu-ray.com. Blu-ray.com is the best information website reagrding Blu-ray DVD releases. You can find all the editions of all movies that are officially published all over the world. Type the movie name in the search bar and choose the country name, you would find all editions of that movie officially published in that selected country.

 

I believe that after reading the eBay policy I quote above, and finding how many listings of Blu-ray DVDs are listed on eBay by individual sellers, you would agree that one can resell an authentic Blu-ray DVD without authorization from the copyright owner to do so. Now I need to prove that my removed listings are authentic.

 

  1. ALL of my removed listings have higher price than usual Blu-ray DVDs. No bootleg or unauthorized Blu-ray DVD could sell for that price.

 

  1. ALL of my removed listings have unique UPC/ISBN. The ISBN are assigned by The International ISBN Agency. You may also contact https://www.isbn-international.org to verify them.

 

For 223485620274 - Ghost In the Shell, it is published in China, it’s ISBN (9787799158587) can be found at WORLDCAT database, NATIONAL LIBRARY OF CHINA and WEN JIN searching engine, which belongs to the NATIONAL LIBRARY OF CHINA.

For 223498350259 and 223564237146 Guardians of the Galaxy Vol.2, they are published in South Korea with ISBN 8809619412844 and 8809619412868. Blu-ray DVD are still very popular in South Korea. These two editions can be found at ALL major online Blu-ray DVD retailers in South Korea. You can’t say that South Korea would allow illegitimate Blu-ray DVD be listed on ALL major online Blu-ray DVD retailers, right?

 

I bought it at YES24.com, the largest Blu-ray DVD retailer in South Korea. It’s like Blu-ray DVD listed on Amazon and sold by Amazon. No illegitimate Blu-ray DVD would appear on this site.

The two key points of my writing are:

First, everyone can sell authentic Blu-ray DVDs without authorization of the copyright owner to do so. eBay policy has clearly stated that.

 

Second, my removed listings are authentic, legitimate Blu-ray DVDs. Therefore, they are allowed to sell on eBay.

 

I believe my writing has sufficiently prove these two key points. If these can’t prove that my removed lisitngs are authentic and legitimate, please tell me know I can prove that.

 

Please reinstate my listings, as they are incorrectly removed.

When you get a Vero violation, towards the end of that email should be contact information for the company that reported you as selling counterfeits.  You need to appeal to them.  You need to contact them with your information, not Ebay.  Ebay won't do anything until the Vero holder tells them that they can.  So you appeal needs to be with the Vero member stated on your email.

 

If there is no contact information [look closely], then call Ebay and let them know you email didn't have contact info and you need it.

Hi, I asked VeRO team, and they said these listings are NOT removed through VeRO. eBay told me that they were reported by a VeRO member, but eBay found that the VeRO member who reported it doesn't have the copyright of the item I was selling. However, eBay then treated it as a normal report and removed it as counterfeit. I have all evidence to show that they are legitimate, and eBay can easily find out thay they are legitimate because they all have ISBN and many other sellers with great feedback are selling them as well. However, they removed them casually and don't accept any appeal.

none of these are on amazon when searched by UPC.  none of these are sold at US retailers with 13 digit UPCs.  you dont know what you are doing.

According to the eBay user agreement, there is no such thing as eBay "incorrectly" ending a listing:

 

"we reserve the right to refuse, modify, or terminate all or part of our Services to anyone for any reason at our discretion"

Fake "ISBN"  listed as "I SBN" or is that normal?

They are published in China and South Korea. The ISBN of China releases can be found at WORLDCAT database, NATIONAL LIBRARY OF CHINA and WEN JIN searching engine, as explained in the letter. South Korea doesn't have a database for ISBN, but the same product can be found at many major online DVD retailers. eBay community moderator thinks it's advertisement so they removed these links from main post. But the links to the same product is still included in the file "letter.pdf". eBay allows importent authorized DVDs to be sold on eBay. By searching "UK BLURAY" you can find 57,351 results.

eBay said that they are "unauthorized items" and "counterfeit", that is different from the fact. eBay does have the right to do these, but the reason they use is different from the fact. If eBay remove items that actually comply with eBay policy, eBay take loss as well, even it's small.

Different countries have different type of ISBN barcode section. Take UK release for example, there is no printed letters "ISBN". But the style of these barcodes are the same.

Searching key words: UK BLURAY - 57,351 JAPAN BLURAY - 35,584 GERMANY BLURAY - 4,456 CZECH BLURAY - 1,620 KOREA BLURAY - 1,065 Only US publised bluray have UPC that can be searched on Amazon. Amazon only sells US release and not all US releases. No results on Amazon doesn't mean that they are not legitimate.
