Ebay refunding thief's and not responding to disputes

Read about such all the time:

Buyer claims not as described and you get to refund em, or eBay does it for you...

May or may not get your item back.

eBay no longer decides case by case, and hasn't for years. 

If a case is opened if you don't  respond with a return label or a refund eBay will refund and let them keep it. If they return an empty box or a different item eBay doesn't give a rat's ass.

1. eBay refunding thieves? - I don't have that issue, as I refund upon return of the 'disputed' item.
2. eBay not responding to disputes? - I don't have that issue, as I respond before a case can be escalated to eBay.
