Ebay needs to make changes to the way people sell an item

There is an item I see being sold. Ebay needs to make a change in the programming dept.  Now if an item is new, and the seller then claims that the item is opened then that is false advertisement.  For example,  why does Ebay allow sellers who sell the Amazon Fire Stick and the seller claims one thing and then puts in that the item was installed for addons. 

 

Am I missing something?  

 

Then these sellers say that they're not doing nothing wrong, nothing illegal and they're doing something prohibited to ebays policies.  Why not be upfront with buyers?   Why are those sellers getting positive reviews when they lie?

I agree with you 100%. As a seller, even if something is opened but unused, I always put it as used. Pre-owned..unused..in my listing..Or if it's something that is just not sealed, I state that in the title or in title say "read full description". When making a purchase, a buyer should know exactly what they are buying..and if things are not disclosed that should be disclosed, it should be treated as item not as described.

I don't think it's so much that sellers are lying - it's more about different interpretations of the word new.

On eBay, most sellers consider an item new if it's unused. On amazon, you can't list an item as new unless you're authorized to sell the item by the manufacturer.

In the example you give, of an item that has been modified, I can think of situations where I wouldn't mind a seller describing it as new. If someone bought a new laptop and increased the memory or added other options but had never used it, it's not technically used, but if the seller explained what had been done and that there was no warranty, I wouldn't be upset that it was described as new.

Booksellers official ratings are Fine,Near Fine, Very Good, Good, Fair, and Poor. For some reason ebay chose to go with New, Like New, Very Good, Good, and Acceptable. The problem with "New" is that you can purchase a book direct from the publisher and it can arrive with flaws. The book is technically new but buyers might not be happy with that purchase. (I used to have a small publishing company, and we would sometimes receive boxes of new books shipped to us from the printer that had damaged books - new but damaged.)

I once opened a record album and it was sealed, but when I opened it, the vinyl had damage and crazing, so, now I open some of my sealed records and take pictures and list them as new, because even though I opened them, I did not play them, so technically, they are new, just not sealed. The happiness of the customer is the most important thing, any customer of mine deserves happiness with their purchase, plus complete satisfaction with the item.

That's just like sellers that get their items from goodwill or a thrift shop, just because the shirt has a tag, or a box hasn't been opened, they list is as new, which it isn't.

@shfquickship73  Most items advertised on eBay as NEW are at least second-hand, having been purchased first by the seller.  Betcha never thought of that. 😃

 

How about eBay items advertised as NEW that came with a warranty only to the first purchaser, with the eBay buyer having NO warranty rights?  Does that bother you?

Actually, if the box has not been opened, then that does indeed count as new.

If it works, sell it. If it works well, sell it for more. If it doesn't work, quadruple the price and sell it as an antique.

Let's be more specific here.  I am not talking about a goodwill item.  I am talking about electronics item which was new,  then opened to install illegal stuff then repackaged. 

 

Wow,  some of the responses so I guess ebay will never change.  When a customer gets a virus and a lawsuit happens, then ebay will take the drastic measures to do something and start banning certain sellers.

If the item is sealed and has never been opened then we would consider it new from old stock.  If the seal has been broken in any way then its used.  We see what you are saying.  Its clear that yes a lot of sellers have there own idea on whats used and whats not.  Sometimes its just a listing error and a simple mistake when doing the listing.  Berst regards

If they altered the product and resealed it, then the item was refurbished and not new with tags.

The suppliers  over in japan and  china  don't  don't spend money  on Shrink wrapping  model kits  anymore . they stop  doing it  10 years  for  U.S. Market  .   The European  suppliers  stopped  also . They use  factory  branded tape to seal the boxes  for the most  part .  And for U.S.   market  . while their own market nothing is sealed up ,because the customers like to look through them .

The programs installed on those sticks are not illegal.

 

It is illegal to use them in a way to obtain free television shows and movies,

which is why the buyers are happy to buy them.
