Ebay defect removal system issue

I had a defect appear today out of nowhere for an item that that just delivered a day ago.  The listing and transaction was from 4 months ago but because of delays on the manufacturer's end could not be delivered until a day ago.   This is something that I discussed previously with the Ebay Performance Evaluation team and they removed the items from being a defect for incomplete delivery.  Now the item was delivered a random defect shows up and Ebay is telling me I only have had 90 days to remove a defect.  Failing to recognize that the defect just appeared today - so yes, retroactively 90s days has gone by but in actuality it's not even been a day since the defect went on.  This was a batch of orders.  8 in total.  That if Ebay insists on refusing to remove the defect will simply destroy me on Ebay.  I'm not sure the point of my being asked to join Ebay Expressions, but here I am saying this is a problem.  When there are system limitations and Ebay can see that, why give the seller (me in this case) a generic decline from a template as if what happened and evidence verifying what happened means nothing?  Is there anything I can do to help my situation here?  I know things on Ebay can be unfair for sellers but this is just a little too much.

eBay allows 40 days for a presale item to be shipped and 30 days for non-presale items. Anything over that would earn a defect.

Here is eBay's help page about presale items.

This is why its a very bad idea to list things for sale that you don't have on hand. Its just asking for trouble, I would never do it. You really can't put the blame on ebay here, you listed things for sale you did not have.

At least its just one defect, and while it may effect your account in the short term, it wont keep you from selling here.

Unfortunately I wasn't wise to all the hassle at the time.  Now I stay away from presales.  It's just less headache like you said.

That said, the collectible market has gradually shifted more and more to a presale format.  Hopefully one of these days Ebay figures out a way to incorporate presales into their platform.  As for my concern, it's still there.  I really bust my behind to excel in customer satisfaction.  Another thing Ebay might consider is an all-around review approach and giving new sellers a grace period to acclimate.  My errors were made when I was still fairly new on Ebay and now I've settled in, it's coming back to bite me in the behind.

Thanks for responding.

ebay definitely takes a heavy-handed approach to their policies for sellers, they could certainly be a little more forgiving, humans are not perfect.

Sellers are often punished for things they have no control over too, such as ebay's junk delivery estimates that sellers have zero control over. Sellers are also punished every time a scamming buyer lies about the reasons for their returns.

The whole system here is designed to ensure you fail, regardless of what you do.

Its not designed for you to fail.

Its designed to be unnecessarily adversarial and punitive to sellers if even if things go right, if the system considers something in the order process to be bad, or a ebay person makes a mistake/error against a seller.  You failing is merely a consequence of the anti-seller system in place here.
