EBay sucks and is terrible for sellers

I sold piece of industrial equipment on eBay , listed as new (see details). As it was in the lab and had not been installed.   After the purchase.  The buyer had me drop shipped to his end customer the customer did not want it.  So his end customer shipped the unit back to him.  I said no returns accepted. And the reason he gave was that it is not new.

EBay sided with the buyer and force the return through me.  This item cost over $2000 dollars so the final fees were over 200.   I didn't like it but they force my hand.  The problem was that the buyer then shipped a different non working unit back to me.  I told EBay about it and called the end customer to make sure that he sent back the correct one. The end customer was purchasing agent for a big manufacturing company and provided me with the pictures of my unit.(it had stickers on it.).  First pic is my unit second one is the picture of what I received.  I tested the equipment and all of the setup files are missing from the device.  So I pleaded with eBay not to refund the buyer.  No only did they sided with the buyer,  they are taking are also not refunding my final value fee.  EBay is does not work with sellers despite what they say on the web page.  I am out over $300, final value fee,  cost of return shipping and PayPal fee.  I would have been fine with it if the buyer had return my unit that was in working condition. So all in all seller beware!  they turn the cheek and let fraud be commited on their system and take their cut. I am going to Bonanza.  EBay sucks!

well,  if the buyer explicitly put on the PayPal message that it's is a drop ship I should have said no?  That's new to me.  The final value fee hit is the icing on the eBay cake!

What you should have done was come here first to ask.

We all would have told you not to do it.

Never ever ship to an addy that is different than PP.

The first buyer has your money, And the money from the scammer.

The second buyer ( who switched out his junk)

Has no problem with the deal.... that more than likley was off ebay to begin with.

Sounds to me like they were working as a team.

Unless the first buyer was selling like items, how would the second buyer find them

I suspect foul play,  You have the names and addy of both.

You can do some internet detective work...

But because you sent it to someone other than the buyer.... good luck.

The second buyer used another person as a shield.

Knowing that you can't come after them, because they did not buy from you.

The first buyer knew that they will win a SNAD every time.

Because you sent the item to a different addy.

In my not so humble opinion.... you were scammed  by pros...

Taking a photo of the serial number means that all the buyer had to do was change the cover.

this is a horrible story and I am sorry it happened to you.

you got scammed and eBay helped them do it.

all of these posters telling you what YOU did wrong?

ok they are right but IMHO that does not negate some responsibility

on flippin eBays part to stop sellers from getting scammed.

this is a big company and I think they can afford to pay a few more CS reps..

maybe in the USA??

all of this nonsense about not shipping directly to the buyer is just  a loophole to aid and abet crime arrrgh... Robot Mad

if its such a NO NO then when you ship you should not be allowed to ship to anyone other than the person who paid you....

Has any seller won on their behalf when they consider they post that the item was not as described??

On items like this you have to engrave marks on them, inside and out, if they return the wrong item back to you, go to law enforcement and file charges.

The one with stickers looks USED

It even has a mounting bracket attached.

The other one looks UNUSED

I would contact someone higher in the company who bought the item to start with.

Otherwise call the police for GRAND THEFT

@hpnuts: Just to be clear here, did you receive that end customer's address with the PayPal payment? (i.e. Was it the Ship To: address that is provided as part of the payment transaction?) Or did the buyer simply email you an alternate name and address and ask you to ship there instead?

I did list it as new other...  in the description.

New Other see details

"lab unit".  I wouldn't have mind getting the original item back, was still a bit irratate, but just not getting it back and paying a final value fee, PayPal fee and return shipping , eff-ing sucks!

Yes, sellers have won SNAD cases, but its a lot of work. You can find out about returns by reading this.

I'm sorry this happened to you, but there really is not much you can do to protect yourself as a seller on eBay. Post good pictures showing serial numbers and state them in the listing helps.

You state the 1st picture is the one you sent and the 2nd picture is the one you got back. Are you sure you don't have that backwards? The 2nd picture is clearly in much better condition then the 1st, the 1st even has an IP address on which clearly makes it used. Maybe it just needs to initialized.

You CAN write back to the buyer and tell him it appears the wrong unit was returned by the serial number shipped. Can he please return the correct one and make arrangements for the return of this one. There is nowhere to go with eBay. I would try that.

I don't know what state you're in but $2000 in California is GRAND THEFT

Contact the company and ask for their law department, explain what is going on and that you don't want to call the police but will do so if they don't resolve the situation.

If they give you any hassle just call their local police and file a report.

You can always hire an attorney and sue them for damages. . .

$2000 isn't chicken feed unless you own a chicken ranch.

Right, that is like asking the bank robber to return the money he got.

The paypal payment said in the message to drop ship to end customer and provided the address.

Well dont buy parts  or sell to from govixar949/serverpartswarehous.  It's probably stolen from someone, and eBay wont help you.  Thanks to everyone for the responses it has made me feel better.

Can you prove to law enforcement the unit you sent out versus the unit you got back ?

The pictures were right,  it was a lab unit and had not been installed in he field,  the unit hat I got back looks new but is DOA,  I have been working with these units for many years now and know it inside out.

It's perfectly fine to ship to an address that is not the buyer's IF, and ONLY IF, the buyer has added that address to their account AND selects it as the delivery address during the payment process. You don't lose seller protection (such as it is) when you do this.
