Your post in all caps and no punctuation makes for a very difficult read.
What I can gleen from your post....your buyer opened a not as described case because they received an empty package.
Someone got eBay got involved...they refunded your buyer.
Well that is how money back guarantee works. You didn't refund the buyer yourself and had eBay refund for you. You probably received a defect for cases closed without a seller resolution.
USPS is notorious for delivering empty packages, I received such a package not long ago.

You are talking with other members such as yourself here. I know you are frustrated, but all caps denotes yelling in the written word. No need to yell at us, we understand your frustration.
The buyer did not find a "loophole", we all have the right to appeal a decision by Ebay.
This is a real problem and many of us have been in your position before. It is never fun. There isn't likely much you can do about this transactions, but in the future. If USPS delivered your package and it was damaged, there would have been notes ON the package from USPS denoting the issue. If it had been completely ripped in half, then likely in a plastic envelop from USPS with the notes on it.
USPS, UPS and other carriers take pics of their packages along their route. UPS takes one when they actually deliver it. USPS likely has one just short of the delivery. Contact your carrier and get ahold of that picture. You should be able to see if the package was damaged.
Now if you can get that information, come back and I'll describe what I would do next.

Not every USPS office will place a note on packages. I received an empty package several months ago, no note nada just an empty package stuffed in my mailbox.

I'm sorry that happened to you. They usually do. You could have requested their most recent pic on the package from USPS as they do have them.
Besides, the OP says the package was ripped in half, one would think that would be very easy to see in a Pic.
