EBAY DOES NOT PROTECT THE SELLER FROM THE FRAUDULENT PRACTICES OF SOME OF THE BUYERS WHO USE EBAY TO COMMIT THEIR FRAUDULENT ACTS,

 

I HAD TWO BUYERS IN ONE WEEK BOTH MAKE THE SAME CLAIM ON SOME USED DENTAL LAB EQUIPMENT i'M SELLING. THEY BOTH CLAIMED THAT THE SWITCH ON THE UNITS WAS BROKEN WHEN THEY RECEIVED IT AND THEREFORE THE UNIT WOULDN'T TURN ON WHEN THEY PLUGGED IT IN THE WALL. 

 

THE FIRST ONE I GAVE A PARTIAL REFUND TO IN ORDER TO MAKE THE ISSUE GO AWAY. NOW A SECOND ONE IS MAKING THE EXACT SAME CLAIM. HOWEVER, THE PROBLEM WITH BOTH CLAIMS IS THAT THERE DOESN'T SEEM TO BE ANY OTHER PHYSICAL DAMAGE TO THE PIECES IN BOTH INCIDENCES EXCEPT THAT THE SWITCH WAS BROKEN OFF. THE SWITCH, OF COURSE, THAT TURNS THE UNITS ON AND OFF, THEREFORE, THE UNIT CAN'T BE OPERATED. THEREFORE, A REFUND MUST BE GRANTED. 

 

WELL, THAT'S A BUNCH OF "YOU KNOW WHAT". HOW CONVENIENT THAT THE SWITCH THAT OPERATE EQUIPMENT ALWAYS SEEMS TO GET BROKEN. HOW AND BY WHOM??? IN THAT EVENT, LET THE BUYER MAKE AN INSURANCE CLAIM WITH THE CARRIER, THAT WHAT THE INSURANCE IS FOR. 

 

IF EBAY ALLOWS THIS CURRENT SCAMMER TO GET AWAY WITH THIS LATEST SCAM, I'M GONE FROM EBAY FOR GOOD. I DON'T NEED THIS SORT OF ABUSE BY EITHER THE BUYER OR EBAY.

Fraud?  Scammer? Because the buyer claims to receive an item that is not working? Could it be possible that the buyer is telling the truth? Could it be possible that you sent a defective item? Anything is possible. We don't know and ebay doesn't know. 

 

Ebay offers buyers a money back guarantee.  It is your duty to accept the return. Pay for the return shipping. Issue a refund when you receive the item back.

I sold an iPhone for $400 the scammer buyer asked for a return which I excepted

when the phone was returned the scammer buyer did not remove his information the phone is now cloud locked with his information and password. I am formed Ebay that the item was not returned in the condition it was sold. They denied my claim stating that they cannot determine if I caused the damage or the buyer caused  the damage. As a buyer you’re instantly treated as a liar and a thief. The evidence in this case is that the phone is currently in the buyers name. eBay has taken $400 out of my bank account. They buried the item is  on my eBay page it doesn’t come up anymore they say the clear the case is closed. This is a big blow for a poor guy. Ebay is a **bleep** company. There’s lots of videos on YouTube with people in the same situation one guy read the letter he was sent it was the exact same letter that I was sent. Saying they couldn’t determine if the damage was caused by the seller or the buyer. This is a scam eBay is a scam company. Do not sell iPhones on eBay biggest scam in the world. I am sort of bond Ebay was Nice for many years to make extra money no more it’s not safe to sell on eBay. There is a class action suit going on you can find the page on Facebook I am joining it

Over the past several months I have had two bad experiences. One as a Buyer and one as a Seller. I purchased a DVD set of "Barney Miller". Several DVD's would skip, freeze or not even load. Since I reported it, after the "reporting period" (sometimes you can't get to watching an entire series in the allotted time period and I was hospitalized as well) EBAY did nothing. It was later determined, by the manufacturer, no less, that they were "pirated" DVD's. Even with the evidence, nothing was done and the Seller escaped without even a negative review.

 

Next, I placed an item for sale and the buyer never paid nor responded to my invoice nor email. I could not even leave a negative feedback and was told a "strike" (which no one can see) would be placed. So, unless your "preferences" are set up for that, the next Seller will never know. Does ANY of this seem fair? There's more to the story after I contacted EBAY but I won't bore you. Needless to say, they were NO help at all and it all left a bad taste. It seems the "deadbeats" and miscreants are being protected and the "law-abiding" among us are not!!!

This is the exact reason I would never sell a expensive item on ebay.  Ebay is a great breading ground for scammers waiting to pounce on sellers selling expensive items.  Ebay gets their money and thats all that matters.

One quick thing, it is not the buyer's job to file an insurance claim with the shipping company.

If insurance was purchased, the seller needs to do so since they're the ones who paid for it (even if they made the buyer pay for it by adding it to the cost of shipping, it is still the seller who purchased it).

 

I want to add more...

Insurance in these cases is particularly tricky, since the shipping company does not want the item re-shipped.  Specifically, the USPS will only honor claims if the item is still at the end of the location it was shipped to when the alleged damage occurred. Reason this is unfortunate is because first not all buyers are willing to cooperate in these regards, and second if the buyer opens a case of "Return for Refund" the seller now has a deadline they must meet and that will likely destroy any claims they may have been able to initiate as the package will be on its way back should the USPS decide to investigate in person.

 

All that having been said, it would be best to set listings to "accept returns" instead of "no returns."

Because one way or the other, the seller will issue a refund according to the Money Back Guarantee.

The MBG does NOT require the buyer return the item in case of a dispute, if the seller should balk then ebay can force the refund... And that may not be the exact way it will be handled, but close enough.

 

Last but not least, ebay WILL side with the buyer every time.

You can try some venue where that is not the case but I think you will find a serious lack of traffic because the problem where a venue sides with the seller is just fraud waiting to happen, too.  And that may sound good for the seller but ultimately it is the buyer who has the money first.

I FULLY UNERSTAND. I ALSO HAD A BUYER MAKE THE SAME "SWITCH" CLAIM ON A PIECE OF DENTAL LAB EQUIPMENT.

ALSO, I JUST TODAY CLOSED OVER 20 ACTIVE ITEMS I HAD UP BECAUSE THE POLICIES OF EBAY MAKE IT NEARLY IMPOSSIBLE TO SELL ANYTHING. YOU LOOK AT YOU LIVE AUCTIONS AND IT TAKE TEM MINUTES TO FIND YOUR OWN ITEM AMONG THE DOZENS OF OTHER ITEMS ON YOUR PAGE. GOODBYE EBAY. EBAY IS SHOOTING ITSELF IN THE FOOT WITH ITS POLICY THAT ONLY WORKS IN FAVOR OF THE BUYER. WHAT WILL THEY DO WHEN ALL THE SELLERS LEAVE, KISS YOUR --- TO COME BACK???

In case you don't, insurance is to cover the seller, buyer has the MBG.

Welcome to the risks of selling on Ebay. It's your word against theirs and unfortunately the famous saying "the buyer is always right" pretty much applies with rare exceptions whether they are telling the truth or not.  Luckily 98%+ of buyers are honest people. But if you sell enough long enough you'll eventually run into a scammer and it's virtually impossible to prove they are lying.  

 

Just follow the process and claim you made no mistake.  Ebay will rule in their favor. And if possible mention what happened in the feedback to the buyer.  Ebay and other sellers will make a note if they see a pattern and they'll eventually get shut down if they do it enough times.
