I received an order from a customer the night before I had scheduled major surgery. I told him his order could not ship for a week and he replied that was fine. His order shipped and was received by him as promised. No complaints. This was all in official E-Bay communications. E-Bay downgraded me out of top seller. Only blemish on a spotless record with customers. I appealed using the process that they suggested when they downgraded me. They replied that I had no grounds for the appeal-- that hospitalization was not an acceptable reason for delay and that this decision could not be appealed. Is this a dead end for me ?

Yes, it probably is. You could have avoided this situation by setting up an appropriate handling time for your listings, since you knew in advance that there would be a significant delay in shipping. You also could have set up "Time away" to block sales during the period when you cold not ship. The communications that you provided to eBay only confirmed that this shipping delay was not due to an emergency medical situation, but rather one that was anticipated.

True, hospitalization or any other reason you can think of is not acceptable.
Though, it is not a dead end. Your seller account is re-evaluated every month. Just keep on selling and of course, don't make any shipping mistakes etc. Extend your handling time if it assures you to get carrier acceptance scans within your handling time.
Avoid having eBay step into any cases you have open. Always handle returns and item not received cases on your own with eBay intervention.
Best of luck moving forward.

I'm sorry this happened to you, but I'm afraid that you didn't lose TRS because of just one defect from one transaction. It requires at least 3 defects from 3 different buyers to lose TRS, or 2 cases closed without seller resolution.
For late shipments, your late shipment rate can't be more than 3% or you will lose TRS, but you have to have at least 100 transactions in 12 months, so that means at least 3 late shipments even if you have the minimum number of transactions.
No, it's not a dead end, no where near it. You should still be rated above average, which is great, and you can get TRS back with time. If you have 3 transactions contributing to the lower rating, then you would get TRS back as soon as the first one ages off your record.

In addition to their late shipment rate, this transaction also damaged their percentage for "tracking uploaded within handing time," which is crucial for TRS status.

If you knew you were going in for surgery, why didn't you plan ahead?
You could have extended your handling time or used Time Away.

Yes, you hit the nail on the head and I didn't think about doing this. That would have prevented this.
