I have been in eBay for over 9 years, and I am a buyer and also a seller. I have purchased hundred items without filing a return until this time.
I purchased a skin care product and the discription stated: Sealed.
When I received the item that is not in the cellophane wrapping, I put it back to the shipping box. I didn't open the item box that was sticked by a tape.
I contacted the seller for returning.
The seller said she removed the cellophane, but it was sealed. It wasn't because the seller used a tape to stick the box.
Therefore, I requested a return through ebay.
The seller received the item back on Sept. 30th
Today she told me that I already used the item, and she will file a fraud to ebay.
Please tell me what I have to do to show my honest.
I greatly appreciate your time and help.

I hope you'll accept the advice to leave a negative feedback for this seller which states only the facts about the item (not mentioning the return or refund).

Go back into the case and escalate it thereby asking eBay to take over.
They will see by the tracking that the seller got the item back, and force seller to refund you your full purchase price.
Seller is bluffing you about the 'fraud' report.

Can The buyer escalate anything yet as eBay does give the seller 6 business days after return to refund
or how does a buyer escalate if a seller decides to fight the return as false SNAD ?

Unless the seller is in the beta partial refund program - if the buyer escalates as soon as they can, ebay will refund them if tracking shows delivered. Heck ebay will force the seller to refund no matter what.
OP, some sellers use bullying tactics and buyers inexperience with ebay to get away with not refunding a return.
Just hit escalate on the case and remember who the seller is so you do not buy from them again. And do not forget to neg them - but do not mention the case or refund - something like -Sold unsanitary opened makeup as new.

So sorry this happened to you. If the seller has issued the refund, then there is nothing further to be done. Altho she says she will report this situation to ebay, there is nothing she can do to you that will hurt your standing. In fact, she is foolish for dragging out a situation that is already resolved in ebay's eyes. Do not communicate with her any further, put her on your Blocked Buyer list and ignore any future messages. You did nothing wrong and nothing will come of her threats.

Ebay gives the seller three business days to refund; buyer would win.

As a buyer, I take pictures when something is not as described.
Not that you will need them.
Seller got item back, shows delivered, and you are refunded.

Thank you very much to all of you. I deeply appreciate your time and help.
I purchased hundred items since I have been on eBay without any request return. This is the first request return that I have ever done before.
I have never left any nagative feedback to sellers, but only 5 star feedback.
The seller scared me, so I think I should be careful in buying in the future to avoid the same problem.
I already responded to the seller that "I didn't open the box and besides you and me, God also knows the condition of the item before shipping and now.".

Hi, Labs! Thanks for checking. I checked myself and 6 days is correct. However, I will say that I have read 3 days many times from a very knowledgable poster and I accepted it as truth when clearly it is not.
