So I sold an ipod to a buyer. My listing said no returns and it was listed as New Other(see details). My details stated that no original packaging was included, that it was like new. The buyer opened a case with ebay wanting to return it because she "Just didn't like it" a week later. I called Ebay twice, both times Ebay sided with me and the second time they told me to go ahead and close the case because it was holding up my Paypal which I wanted to use for Christmas shopping. Then I got a notification days later that the buyer had opened a case with Paypal. The buyer changed their story to SNAD, that I said it was new in an open box. I responded to the claim on Paypal and attached pictures proving that the buyer had changed their story when it was a case of buyer's remorse on Ebay. I included pictures of my listing, my description, the item, etc. Paypal sent me an email that they have found in the buyer's favor and that I have to refund the money. I don't see how this happened with all the proof that I had sent them. It's like they didn't even look at any of the evidence. So I wanted to file an appeal for a second opinion and this appeal button is apparently imaginary and doesn't exist. What do I do??? I really don't think I should have to pay the $125 back to the buyer because they "just didn't like it".

Any store return is automatically going to be used unless the box is still factory sealed.

If it's 'new' or 'like new', where is the packaging? Or is it used but still looks more like new?

My description said it was like new, it was a store return bought with intention to resell. I shipped it in a hard plastic box to ensure no scratches or damage inside of a bubble mailer. There was absolutely no blemishes on it, it was in pristine condition. We looked it over throughly and ensured it was in full working order. My desciption was New Other(see description) and my description said Like new, no original packaging included. Why it had no original packaging is not relevant to this case though. The description stated no original packaging included so the buyer was fully aware of this fact. There is an option on ebay when making a case for an item not as described. They did not choose this option. They chose "Just didn't like it". They changed their story when filing with Paypal because they knew that was the only way they'd get thier money back. Thier claim that I said it was New in an open box is fake.

There was absolutely no sign of use on this item. It was like new. If they had opened a case with ebay as it being not as described I would have started a return. Why open it as "Just didn't like it" when the option to open it as "Not as described" is on the same drop down menu? I am not a big seller on ebay and I am still learning the ropes, but I feel that I was not misleading in my description.

You were misleading. You sold a used iPod and should have listed it as used, not "like new". You could have accepted the return request through eBay and refunded the item price only since it was a remorse return. Sellers need to realize that winning an eBay case isn't the end, the buyer still gets to take 2 more swings--PayPal dispute and credit card chargeback.

Thanks for the information. I stand corrected. I learned something new. Her claim with Ebay was one of clear buyer's remorse though. If I get the item back I will list it as used in the future.
