Buyer claiming item received is completely different than what I sent

Started selling a few clothing items to clear out some space in my closet. One of the buyers has submitted a claim for “Item not as Described” and she sent pictures with my packaging with a comic book that she claims was in the package. I sent a her a dress and I’m sure what was listed in the auction was what I sent in the package, there is no way this comic book was in the package I sent, I’ve never even seen the book she has in the photos. It was strange, the package took a week longer than it should have to get to her (sent priority mail but took 10 days). 

I was going back and forth with the buyer and accidentally hit “Continue” when “accept return” was selected instead of ”send message to buyer” Now eBay says they will send a shipping label at the cost of an additional $9 to the buyer to send the item back if I don’t provide a label. I don’t want to accept the return but my understanding is I can’t undo that at this point. The item cost +shipping was only $12, I already spent $9 to ship it to the buyer and I don’t want to pay another $9 for the buyer to return a comic book that I don’t want and then have to refund them on top of this. What do I do? Is my best/only option to just refund them to avoid paying additional fees for shipping, or can I have eBay resolution step in to help? Is there any way this can go in my favor?

No no no, do not let eBay step in to make a determination. If you do, your account will be penalized with a defect and non-reimbursement of your final value fees, and the buyer wins anyhow. Tell the buyer to keep the comic book and then refund them through the case.

You also need to familiarize yourself with the eBay Money Back Guarantee terms in the policy. You can get yourself in a lot of trouble by not knowing the rules. Below is the link to that policy.

Nope, you must accept a not as described return.

 

You can just refund to minimize the financial loss, or pay to have her return it/still refund/then appeal.

 

Which you’ll lose. It’s he said/she said. But it puts the buyer on Ebay’s radar if there’s a repeat of this sort of thing.

 

Any chance you really did mix up items?

I don’t even own the comic book the buyer is claiming was in the package, no way that came from me. I’m positive that I sent the dress that she purchased. I filed a buyer complaint with eBay about this, but not sure of my options are outside of that. 

If I don’t sent a return label does eBay send a label to the buyer automatically? Is there any way I can stop them from sending a label and charging me?

I suppose its lucky this happened on a $12 transaction and not something more. It’s still frustrating, I was under the impression eBay had protections for both buyers and sellers. Seems buyers can easily take advantage and make false reports about things like this.

How could they protect you?

 

They weren’t there to see what you packed and shipped.

 

Even I asked if there was any chance of a mix up.

 

It’s an awful lot of effort to go through for a $12 scam, on what must be a fairly garden variety item or you would have priced it differently.

Maybe the package was inspected and it got messed up in the inspections room?

 

I would just refund and be done with it. Put the buyer on your blocked list. Once in a while, you run into someone who knows how to manipulate the system. I would then report the buyer and explain the situation to them and if they have a similar incident...they'll take care of it. Unfortunately it seems ebay learns about bad buyers at sellers expense.

 

This is scary to see because it could indeed happen on a much more expensive item. And you can't even leave them a negative comment. It's kinda blackmail and I would like to know the buyer so I can block them too. Maybe there should be a website where ebay sellers can post names that other sellers can block because ebay won't tell you how it was resolved so we need to figure something out to stop this. It seems to happen more often than I remember. A creative buyer is a creative buyer.  I can just imagine though how many bad buyers URL's would be posted. It would glitch out ebay's system if every seller had such a blocked buyer list.

 

It's these types of transactions, (I've had a few myself) that make me say in survey's I would never recommend this site to others. UNLESS you are a risk taker. There is a lot of risk involved. Most folks are genuinely good but when you have these experiences you wonder what is going on.

 

I sent a poster to ENGLAND. I did not normally do international, but this buyer pleaded/begged me to ship to them. IT was $200. I paid $10 for it at a thrift store so said ok, they made me feel sorry telling me they had the item when they were a kid and that their poster was burned in a fire. So... I sold it to them. It was $180 to ship because it had to ship flat because it was mounted to a thick board(from the factory). So it was $380. (It's a rare poster and on ebay sell for $300-500) so I ship. A few weeks later, I get a message saying the item was damaged. They sent pics. It wasn't damaged in the pics, but upon MICROSCOPIC EXAMINATION, there was a little bit of FOXING on the paper. I think it was the glue under the poster that bound it to the board. (this could actually be seen in the pics I posted.) It is 60 years old! I said, that's patina NOT DAMAGED! They said "It's damage". Ebay says send a return label for $180. I'm like huh? I'm not going to pay $180 to return a false claim of damage. I fought it. I lost. I talked to another ebay agent who said, PATINA IS NORMAL WEAR & TEAR! YOU SHOULD WIN in an appeal!!!! So I filed an appeal and I lost immediately. WHY? The reasoning was I did not give a return label on damaged goods. So  refunded the $200 PLUS $180 (original shipping) AND didn't get the poster back. I didn't get the fees back/ebay/paypal because I didn't take the return. So after it was over, I paid back the $200 plus original shipping $180 plus all the fees and my original $10. They said I should have returned it so I could report the buyer. HUH? If I wanted it back the first time round upon complaint, I'd have had to pay $180. and then $180+200 when It arrived.   All for an item I stumbled on for $10.

Because they did pay $200 (which was returned), My loss was the $50 in original fees, (ebay/paypal) and $180 for the original shipping and I think $30 in packing. LARGE CARDBOARD and BUBBLE WRAP, TAPE etc so I was out about $260 plus the poster. They got it all for FREE.  Under used items rules, PATINA is NORMAL WEAR AND TEAR. If they said "NOT AS DESCRIBED", I would have won and they would have kept the poster at the price they paid. BUT... because they claimed DAMAGED. And I didn't provide a return label. (because I thought it was RIDICULOUS) I lost it all. THEY KNEW WHAT THEY WERE GOING TO DO BEFORE THEY PURCHASED my VERY RARE/UNFOLDED NEW YORK CITY SKY VIEW ANATOMICAL POSTER FROM 1960. I actually didn't even have it on ebay. The person found an old listing and inquired, almost crying that I sell it to him. I couldn't believe they found a listing over a year old. It was hanging on my wall for over a year! My wife was disappointed I sold it! IT was so nice. The DAMAGE was the aged glue under the poster that bound it to the board. THIS WAS DONE AT THE FACTORY. THE POSTER WAS MINT. You needed a magnifying glass to see the "damage". With the naked eye, you couldn't see it. I showed SUPER CLOSE UPS in the description and you could actually see what looked like LIGHT FOXING. DAMAGED!!!!?????? I packed the heck out of it. It was HUGE, like 50x30! When they said damaged, I thought the mail put a hole through it or it was bent. Nope, it arrived as sent. FRAMED!

For $12, pay and run fast and block. Sorry for the rant. Just trying to explain that anything is possible.

Ebay has a few seller protections, but not for Items Not As Described cases. Therein lies the risk. A dishonest person can easily manipulate the system. Thank heavens most people are honest.

The seller protections are 1) online viewable delivery confirmation (i.e. tracking) can protect a seller from an Item Not Received case. 2) Buyer Requirements contain blocks to a) prevent serial non-payers from purchasing from those sellers who set it up, b) prevent a person from purchasing that lives in a location you don't ship to. c) prevent a person on your block list from contacting you. 3) eBay provides a Block List for specific members you do not wish to do business with. And 4) eBay provides shipping exclusions to those countries, regions, etc. you do not want to ship to.

What a terrible situation you had to deal with! I’m so sorry that you had to go through all of that. That buyer was clearly trying to get over on you and it’s terrible that eBay makes such quick decisions in favor of the buyer without even looking into the details of what happened. If you don’t follow their guidelines to a T they use it as a reason to deny any claim. 

 

I was just trying to make some extra cash selling some unworn items from my closet and clear out some space. I’d just never had an experience like this on eBay and I wasn’t sure how to go about handling it. I appreciate sharing your experience so I understand precautions to take in the future.

Thanks for your response. Makes it worth taking the time to share. As the previous post before yours says,.... thank god most people are good or it would be loss after loss. Crazy things happen. And, yes, ebay looked into it. I was online all night for a week with England. They said, "we told you to accept the return and if you got it back not damaged, then you could have reported the buyer." So at MY EXPENSE, ebay learns about potentially corrupt people. I just couldn't take the chance returning it because I know the buyer, if I returned the $180 to ship the item back, probably would not have spent the time and effort I did when shipping to them and it probably would have came back damaged, then how could I prove to ebay it wasn't when the buyer receive it!? Lol, makes no sense. But we live and learn, I guess. It's expensive sometimes. I DO NOT RECOMMEND ebay to my friends. I say be careful!

Once I sold a drum set locally. $500. The buyer came, picked it up. Seemed pretty happy. Then 90 days later, they filed a claim for non receipt. I had no tracking or proof of delivery because I didn't ship it. $500 GONE!
YET we are supposed to accept paypal for local goods that are picked up. There is no way to list without doing go. I heard they fixed this but I'm not sure because I won't sell anymore with local pick-up.

Omg this JUST happened to me too! Buyer claimed a blouse was not received but a guidebook for the Catskills was sent! And she is claiming I sent it because I live in the state where the Catskills are located and is requesting a refund. I have never even seen this book she is claiming I sent instead of the blouse, I ONE HUNDRED PERCENT sent the blouse and have never had an issue like this before.  How has other people resolved this issue?

Tell the buyer to return it for a refund.

If they open a case, accept it, send the return label and wait.

No back and forth, just tell them to return.
