OK, I have an item for sale as BIN with a BO contingency and an auto "accept" at a lower price. I have a buyer (#1) interested, but needs to wait a few days to pay. He bid and I countered at my "auto accept" level, they have not yet responded (not accepted counter offer).
I understand that IF someone else (#2) comes along and bids higher than that counter offer I can, per eBay rules sell to #2 with no defect.
So my question is this, what happens if someone comes along and "buys" it at the BIN price? (or bids at or above the minimum "auto accept level?") Can I contact #1, report the BIN offer (or better price) and see if he wants to bid even higher? In this case #2 thinks they have a sale, yet I sell it to #1.
What is the hierarchy of BIN vs BO?

BIN stakes priority. If someone else comes along and buys it now, the counter offer you sent is automatically declined & the person who bought it gets it. If this is an auction with BO, then the BO option goes away when someone places a bid.
