I listed the item in subject and it was booted off for a violation yet there are others selling the same item and they are not booted off.  Any suggestions?

So those don't require a prescription? 

PS: did not know exactly what the item was so did a search.  Saw only one seller with those exact same needles, but perhaps you found others.  

Did you know that you can report listings that are against the rules?

eBay does not allow that to be sold here.  They can't catch every listing.  Don't relist them as you can be banned from selling for life.  Have to find another place to sell them.

I just tried to report someone who was selling something clearly illegal and I got the..."We ran into a problem.  Try again later."  It's always something. 🙄

Selling the syringes are allowed but not the needles. Don't worry what others are selling, you got caught so don't relist.

@soh.maryl there are many sellers overseas selling these mostly Italy and Germany.

They appear to require a prescription and if so are not allowed. 

The fact that eBay's policy enforcement is not comprehensive, accurate, or timely would not change that. 

Speeding is still speeding and you are subject to a ticket, even if others manage to do it without being caught.

eBay wouldn't let me sell an insulin pump belt holster.  They said nothing to do with diabetes could be listed, and if I tried to relist, I would be suspended. Wow. I know that hundreds of people sell meter strips, and other people sell holsters, but I sure wasn't going to take a chance.
