Another Scam.What can we do?

I sent a brand new Eileen Fisher Jacket sold for 298.00.She paid 85.00.As soon as she received it she wrote that it had a big rip under the arm and smelled like smoke.I am 79 years old and no one smokes in my house.Something has to give i can't keep giving my stuff away.I will fight this but with no hope of Ebay not giving me a defect because you know they will decide in her favor.I sell on Ebay because all i have is Social Security. Sellers we have to do something.

Another Scam.What can we do?

Tell them to file the return through ebay refund and block.  They are probably trying to get a partial or the whole thing for free its hard to tell these days.  Hope this helps.  Best regards

I don't see it in your solds. Buyers only have 30 days to file a not as described case. Is a case open?

You will not win.

 

The buyer doesn't have to prove smoke odors or rips.  

 

And by fighting you'll get a defect for having a case that went unresolved by the seller.

 

Accept the return and put   her on your blocked buyer list.  She might just be fishing to get it cheaper and will end up keeping it instead of returning it.  Or if it didn't fit she know's return shipping is on her and she's lying to stick you with the shipping.  And if it's returned expect it to be ripped under the arm if it was too small.  Rips happen when the clothes are too tight...........

I think that's an accurate assessment of the outcome, so I would suggest just accepting the return and taking it back. (I'm assuming here that she has actually opened a return request...?)

 

You won't get a defect unless you fight the return and lose, and we know that if you fight the return, you will lose, so best to just take the return back, and block the buyer to avoid further difficulties. 

 

There is also some slim chance that if you accept the return (and not get led into haggling a partial refund, which she may be waiting for you to offer), then you may hear nothing further. 

 

If there's no actual return case opened yet, just an email from the buyer, I would keep a reply short and businesslike: 

 

Dear Smokey the Ripper, 

 

I'm sorry that you were not happy with the jacket. You are welcome to return it for a full refund.

She has filed a return with Ebay and today she shipped it back .I will probably get it with holes under the arms.I will just have to accept as you told me to and refund and block.I just cant understand why we have to keep letting scammers do this to us.There should be some way Ebay would listen to us.I do have pictures of the under arms as if that would be any good.

Just tell her to return the jacket for a refund. This may make her just go away. If not, well, you get your fees back and hopefully the right jacket. I'm sorry this happened to you.

Not surprisingly selling on eBay can prove to be disappointing for those living on fixed incomes, nowadays.

 

Very sad that current policies encourage dishonesty and result in financial loss to those least able to afford taking the loss.

 

 Ebay should really discount fees to sellers with only social seurity income. IMO

@pennysue1234swimwear   I know how you feel.  Unfortunately, that's the kind of *&^% you have to put up with here if you want to sell on eBay these days.  Buyers know they can work the system and they know how, so they do.   Sellers to a great degree are just sitting ducks.

 

Your photos won't do any good.  eBay won't look at them.  They'll say they have no way of knowing the photos you took are of the item you sold her before it was sent -- so it's matter of your word against hers and when push comes to shove, eBay will side with the buyer because they want them to be happy campers.

 

So best course of action is the one that's been suggested and you're already following.   Have her return for refund, put her on your blocked bidder list and soldier on here or wherever that may be.  😞

I forgot to mention: even if there are holes under the arms (such as from the buyer being too big for the jacket), you might get lucky and find that they're seam separations, not tears in the material.

 

I say this on the basis of owning a cheap souvenir jacket that I bought at Mount Rushmore a few years back. It was a favorite of mine, but I really should have gone one size larger with it, and on a couple of occasions while seated in my car, I twisted in a weird direction and tore open the sleeve seam at the shoulder on one side. The nylon shell (or whatever it is) of the jacket had zero elasticity, so when I overloaded it, the seam threads let go. 

 

In terms of failure, that was the ideal way to go, because it just needed restitching along the same inside seam, and that was that. A local dry cleaners with repair facilities did it for me, cheap. I managed to rip both sleeves on separate occasions that way, so now I'm more careful with it, but the jacket itself is still perfectly sound and has no signs of repair.
