An ebay seller copied my listing descriptions word for word.

I have someone selling similar products of mine...which is fine, as the market is similar...But I clicked on one that looked extremely familiar and was even more shocked to see that they copied and pasted my exact description...even the part about them striving in customer satisfaction, blah, blah blah. They aren't selling much and I'm not concerned about the competition, but the principal of it. Am I wasting my time reporting this, or should I contact them directly, or leave it alone? What would you do?

I would just leave it alone.

 

Why get them angry where they possibly try to sabotage your account.

 

And ebay will not get involved.

They know who you are (their competition)

this is proven by the fact they found and copied your listing.

 

Put them on your Blocked Bidder List

And sometimes, eBay lets sellers use photographs and listing terms.. of other sellers

because eBay may harvest them for the "eBay Catalogue"

An ebay seller copied my listing descriptions word for word.

I had another seller use my pictures, which included my hand in the pictures, holding the item. Now that was a weird feeling. Then he priced his exact same item for exactly $1 less than my listing. I know it's frustrating, but just let it go. There are worse things that could happen. Maybe he sells his first, but if it's a popular item yours will sell next.

Unfortunately, there are sellers with no experience and are too lazy to come up with their own description. Usually its the type of ppl who walk around looking everything up on their phone to find out value and then if they buy it they go right back and copy the description of another. Mainly it's because they haven't a clue about anything without their phones and relying on others. I know several ebay selling newbies who do this all the time.

It's like the kid who'd copy your test paper. Why bother studying and actually becoming knowledgeable when you can simply sit next to someone who is and copy off them. The difference is in school the kid may have ended up with a failing grade or in the principals office if caught, on ebay they could care less and basically encourage it, they removed the report link for it a few years ago! It's pretty pathetic.

You can report any listing for infractions -- misrepresenting a product, using copyrighted text or images without permission and probably a couple of other reasons.  Depending on my mood, I may e-mail the offending seller and ask that he/she remove the listing before I formally report the plagiarism to eBay.

 

To help prevent other sellers from copying my text or photos, I include a copyright line in my listing template.  I also may add a copyright line to images.  It helps that I often list multiple items per listing and that many of my items are OOAK or not very common.  I try to include details in the descriptive text that do that apply to another seller's product and phrases that are uniquely mine. One of my favorite take-downs involved my description of a "fluffy-puffy" Steiff critter.  A quick comparison by eBay and the other seller's listing was gone!

 

Of course, I also place actual or potential "competition" on my BBL -- so they can't buy the product from me to fill an order.

Ebay removed the report button.  They will not get involved.  They will tell you to work it out with that person.

 

IMO this is a conseqence of sellers using "sell similar" to list.

When I see a seller using my pictures or text, I send the seller this email which you are free to use:

 

"While I am flattered that you like my listing (pic or description) I did not give you permission to use it.

It is not only against Ebay's Image and Text Theft policy and reportable, but it is also against US Copyright law.

If you do not remove it ASAP, I will have no other choice but to report you to Ebay. If it is removed by Ebay, you will have a strike on your selling account.

Thanks."

 

So far all sellers have complied.

I give sellers about 10-12 hours, then I report them & call Ebay.

Make sure you block the offending seller ID ASAP.

The Report Item link is directly above the item number, far right, on the same line as the Description / Payments & Shipping tabs. I have used it successfully on several occasions although I have not needed to report a copyright violation recently.

Not sure where this was discussed, during the weekly chats or updates, but ebay has said that it will no longer get involved when ebayers use each other's pictures.  They suggest you work it out yourself.

 

So I would assume the same holds for copy as well.

I've had a buyer steal my photos for 5 listings, copy and paste the descriptions.

 

called eBay and hey said there's nothing they can do. 

 

I just suggest making sure your price and shipping is lower!

Ebay didn't remove the report button. It's still there but requires you (the infringement victim) to file a VeRO report. And although it sounds complicated, it's simple and the benefit of a VeRO takedown vs. ebay removing a listing through the old report is that a VeRO ding on the picture or description thief's account is huge. It's a much more serious infraction.

 

Description theft (plagiarism) is more difficult to prove so as @duchess-at-speakeasy suggested, use of unique and unusual adjectives and language can prove the work is your own and was copied. (I once proved a text-theft case when I realized I'd made a typo that the plagiarist copied!)

 

@emerald40- the report button is there and when you click the copyright and infringement button, it refers you to VeRO.

 

Ebay does get involved, but not through the "report" button. And as I'd commented, when you report as VeRO and successfully get the listing removed, the red mark on their account is painful. (I've never submitted a VeRO report by snail mail. I use email according to the DMCA/Notice of claimed infringment below.)

If that button is directing you somewhere else where you have to make a VERO claim, then essentially ebay did remove its initial function.

 

And as I said before, unless you can prove copyright, it is not going to get you anywhere.

Nonsense. Copyright complaints are unique (only the rights-holder can file); therefore, they require an extra step. That "Report" button still serves the intended function, and was not removed, as you claimed. Cut your losses.

 

The only "Report" button that eBay has removed is the one that used to be in eBay messages between members.
