I sold and delivered an item with tracking for $50. The day received, the buyer wrote that the package was empty when arrived and had been taped over. I asked him to save the box and the materials for a claim that I would file that USPS would need information from him. I filed a claim, but he said he threw away the box.I suspect this is a scam. The USPS file has been started, but he Is not willing to do anything regarding it. Am I just out of block, will I be forced to refund?

did he file not received or not as described?Buyer does not have to participate in an insurance claim and you will win a not received case but if its not as described case you probably will lose and have accept return.Buyer then can return any box w label you provide for full refund.If it is a not as described return request if you d not accept on you own and allow it to go to ebay you also will get an account defect

My gut feeling is that you will have to refund. My common sense tells me the buyer is shady at best. Sorry!

The buyer has nothing to send you back for a refund and they cannot state it was not delivered if you have tracking that shows it does. Therefore, without a box for the buyer to present to USPS and no product to ship you back for a return/refund, they won't return and therefore the case will be closed in your favor... unless they ship an empty container back to you.
Doubtful that this type of item is being scammed, but you never know with people. Seems the average person would contact the seller and want to show the condition/empty box and not just 'throw it out'.
