Account was hacked in March and they started selling items above $600 and now I am getting 1099-K

The account that has posted this is not the one that the items were sold on because that account is suspended for selling fees (wasn't me). I contacted Ebay support to help me a couple minutes ago and they said my account was not hacked and that it was somebody who had access to my device, which it wasn't. People has purchased the Xbox's and I cancelled their order except one of them because it was after I had cancelled the other ones. A couple days ago, I recieved a 1099-K that did not have any of my info, except my address and Ebay account info because I did not provide them with my SSN or ITIN or TIN. Ebay will not help me remove these charges from the form and I do not know what I should do because I don't want to be liable for this, but I also do not want to get into legal trouble with the IRS.

@gagus49  here's info from the IRS on what you need to do if you were the victim of identity theft (which a hacked eBay account would be) and that identity theft is going to affect your tax filing.

     I am a little confused by your post. Are you saying you sold and shipped one Xbox for under $600 but after that sale somebody hacked your account and started selling additional Xboxes and you cancelled all those orders? If that is the case there should be no fees other than the $.30 fee per order. 

     How did the hacker manage to try and get the funds from the buyer? Did any of the buyers actually pay for one of the Xboxes the hacker sold? Nothing makes sense here there is some information missing. What was the account the items were sold on??

Would that be identity theft though? Just login to a e-commerce website and Ebay also doesn't have my SSN, ITIN, or TIN. Should I fill out Form 8300?

     I am unable to get enough information out of your original post to determine exactly what the situation is and that may be more information than you are willing to post on this forum anyway. You may be well served by calling the IRS hotline at 1-800-829-1040. They are open 24 hours a day.

@gagus49  I am only going by what you posted above, which is that you said your account was hacked.

 

Like @dbfolks166mt  said, you haven't really provided enough info here for us to give detailed advice and even if you did, my advice would still be to contact the IRS because I am not a lawyer or tax specialist.

 

Over the last several years there have been many people reporting they received 1099-Ks for items they didn't sell and in some cases for accounts they didn't even know existed because fraudsters used their names, addresses, and/or SSNs to operate accounts and sell items on eBay.

 

My advice to those people was the same.

 

Unfortunately, eBay and the IRS are the only ones who can really help you with this.
