I’m wondering how I can dispute this cause I have clear evidence of me not getting my item back.

What do you mean...
* Was a return opened?
* Did a refund get issued?
* Did you issue a refund?
* Did you receive anything at all (even an empty envelope).
* If there was an open return, have you checked the tracking of the return?
Missing a whole lot of details here.

If customer "never returned the item" your case will close automatically (after a period of time).

Did your buyer open a return?
Did you accept the return?
When you accept a return, a return label is generated and sent to the buyer.
Did you send the buyer a refund?
If you sent the refund before receiving the item back you have no recourse, because refunding before the buyer sent the item back tells the buyer they can keep the item.

Did you refund before return? If so, return is closed.
Did you pay for the return label, and get nothing back? If it got shipped, and you did not get it back, by eBay policy, as the purchaser of the label, you lose even if you don't get it.
