If my account is still visible look into my account and read my feedback and look into my Store & whatnot so you can see I'm a good person who is giving, fair, and being honest in my testimony below.
IF anybody can help me in any way shape or form please. I have been a long time member for 12 years with 202 transactions, 100% feedback. I've been robbed by a scandalous buyer on here who at the time
I have been taken advantage of by a customer (suspended at the time he paid me) who initially violated 2 of ebay.com policies (at the time i didnt know this) and had me violate 1 myself ( at the moment i was unaware that I was doing so ) by accommodating his needs by fulfilling his request to ship my item to a different address across the country from the address intended . # 1. EBAY has not throughly investigated this! # 2. I have appealed and was denied in less than 12 hours! # 3. Ebay enlightened me the day after the purchase had been completed the User from what ebay had stated is (#1) one in the same individual,(#2)who in fact got suspended on the night the transaction for God knows what but not associated with this here. I was only able to have them tell me he is HIGH RISK & HAS MULTIPLE RED FLAGS! I called ebay support the day after the transaction took place ( followed by every 36 hours or less) to inquire about this individual because something just didn't feel right and I inquired about the user and reported what had taken place. I was informed from my GF that I had violated an ebay policy. She is my partner and shares the workload with me. Needless to say if anyone has any insight whatsoever please help me. THIS IS MY CRY FOR HELP! ebay lies and doesn't do **bleep** to protect you! I need to escalate this before I have to either file paperwork at the Courthouse or local Police Department.

Ebay won't help you as far as they're concerned, they don't give a rats ass anymore about the seller. Only the buyer is who they are concerned about. For 2 month I have been trying to get Ebay to listed to my concerns and to take care of me as a seller, but they don't care.

Oh I might suggest going to the better business bureau and filing a complaint. I have already done that and maybe if more and more customers do this then maybe it might make something happen. just a suggestion though.

if a buyer asks me to send to a different address then you just say NO..........end of story
you broke a very important rule that was simple to avoid
perhaps if you were familiar with the rules of the MBG then this would not have happened

eBay can not help a seller who has not followed the protocol of ''Only ship to the address on the eBay order'' - don't see the BBB being able to do much about that either.

You are out the item and money because you did not feel it was worth your time to read and understand the workings of eBay. You decided and only you to ship to a different address than what eBay told you. Sit back and realize it is your error. Chalk it up to lesson learned. We all make mistakes.

Is there anyway you could get a lock on the phone so the person who scammed it from you is unable to use it? Just a thought.

There is a lot of information that is NOT in your OP. How did this scam happen? Did the buyer open a INR or NAD case with eBay? How did you respond to the case, or did you? Has your account been suspended or are you referring to the buyer? Posting title indicates you were suspended. You mentioned escalating something what are you escalating? Hopefully you have the serial number of the phone otherwise any police report is probably going to be useless since they have no way to identify the item. If you have the IMEI number you can report it to the IMEI blacklist which basically renders the phone useless to the buyer.
This is going to be a tough battle to fight simply because as others mentioned you did not follow procedure. Cell phones and other electronic devices are HUGE targets for scammers. Personally I would never list one on eBay.

eBay can only do so much to protect you. Too late now, but you should have requested a package intercept request as soon as you discovered your error. No one deserves to be scammed, but this one isn’t on eBay.

Don't waste your time. The BBB is a scam itself, just a form of advertising, with no power to influence anything.

You're required to ship it to the address eBay provided. You didn't do that. That is why you lost. That is why eBay didn't protect you. Sorry but this is your fault.

Did you notice the $39,000 Pokemon card? Their past sales are relatively low cost items. I'm wondering if that set off some red flags, not to mention there are multiples of the same for big $$$.

This type of thing happens a LOT to sellers who 'don't accept returns'.
I wonder if there's a connection?
Anyway, you shipped to an address not provided by eBay. Sorry, but that's an automatic loss.

So sorry this happened to you.
It is important to listen to your gut instincts. They are usually right. If you have misgivings about a sale again, it may be better to cancel the sale and take the defect, if your account is clean. (Too many defects and you’re toast, so a seller must exercise caution when deciding what to list. Some items are scam bait. You have to weigh the risks against the profit.)
What happened to you is one of the risks we sellers face with online selling. Because of this, knowing the policies and procedures of the platform is crucial to prevent what happened to you here.
It is only safe to send a sold item to the address on record with eBay. A seller is on their own, and voids their seller protection (what there is of it) when they alter that address.
There is a common scam going around eBay where another user poses as your buyer and requests the item be sent to a different address. In that scenario, if a seller falls for the ruse, both the actual buyer and seller lose out. Actual buyer doesn’t get his item, the seller has to refund him, and therefore loses the money and the item.
So you can see the importance of mailing an item only to the address of record. In the future, should a legit buyer fail to use the right address when checking out, you may need to cancel the sale and the buyer will have to re-purchase with the corrected address.
Hang in there. This was an expensive lesson, but every experience can make us stronger and wiser if we learn something from it.
