File a not as described case against the seller by going to the transaction click "more actions" under purchase history and then "Return Item." When you say "Ebay took the site down now I cant get a hold of ebay to return the item." Are you referring to Ebay removing the seller from the site? As in "Not a Registered User." You might need to contact Ebay then through the chat box under contact us cause there may be a problem then.
