About 4 months ago I bought a modded ps3. A bunch of issues happened in between now and when I bought it so they shipped it late. They originally had a tracking number but they did not use it, so they made a new one like last week or the week before and updated it when I reported the item had not shipped. The new number also does not work so I cannot escalate the report to ebay. I did get it the ps3 about 7 days ago and it has no games or anything on it like they said it would. Now the seller is ignoring me as of 4 days ago.
I tried finding the email for ebay customer service but they don't provide us with one so I have no clue what to do. It seems like I have been scammed because the seller doesn't have to do anything now that the 30 day return policy is no longer relavant and they gave me a fake usps number to track that will never be marked as delivered.
Can someone from the customer service help me or something? I have no way of fixing it. Its like I am in checkmate.

If you're 4 months past the date of purchase (and probably past the estimated delivery date), you're too late to file any claim through ebay.
You aren't specific about the "bunch of issues happened" and whether you were the one with issues or the seller, but at this point, I think you're SOL unless you can file through your c.c.

1. The issues were on his end. Modding a ps3 was supposed to be easy but be restarted twice and had trouble with the dlcs.
2. How is it my fault that I am past the return date if it DID NOT ship until last week? On top of that, the tracking number still says it is invalid so ebay cannot even tell if it has been delivered.
3. You cannot file it with a credit card company because ebay will report you for essentially taking money from them.

The "delivery date" is 7 days. The tracking doesn't state that it his shipped, so again, I am in checkmate. You cannot return it if it never delivers, and he gave false tracking info twice.

I probably should have refunded it earlier, but I wanted the modded ps3, so I let him do his thing. He seemed very cooperative so I didn't expect him to scam me. After 2 months I started asking him questions, but he gave legit answers so I just let it be. I honestly expected to be able to return it if I ever received it because ebay says you have a 7 day return window if it ships late, but the fact is that he has given ebay false tracking info. I cannot do that, and ebay has no way for us to tell them that it is false. This seems more like a failure on ebay's part for allowing false tracking info to be accepted and not allow us to report it.

If you paid by credit card, contact your card company.

I did not pay by credit card unfortunately. It was an 800 dollar purchase and I use my credit card for stuff under 100.

I was able to contact ebay customer support but I had to specifically search for their chat service. They actually expedited my issue and made it top priority for them which is nice. They gave him 72 hours to respond. I assume they may refund me if he does not respond and it will mean he owes ebay the money, which if not paid, the government will go after him for it. That is generally how things work when you scam in the US.

2. How is it my fault
Because if you followed the rules of the MBG you wouldn't be here.

It doesn't matter tbh. Ebay is fixing it. Realistically I followed all the rules anyways. The seller did not, and I reported him for it. Ebay customer service said they would remove him from ebay after they get my money back from him.

Please come back to let us know when you get your refund.
