I recently had a buyer return an item that I never received. According to Ebay it was delivered based a picture of the item in front of my gate on a public street. Ebays policy is that any item worth $750 or more requires "signature required". which the buyer did not do.The buyer was issued a full refund using Ebays own money. Ebays is now holding me responsible for the buyers full refund.i don't have the item and now i'm responsible for the buyers mistake. Both Ebay and the buyer have not followed Ebays own policy .why is Ebay discriminating against me as a Seller when i'm the only one who has followed policy ?

That is when the sellers ships the item.
Returns don't have SC, unless the buyer or seller wants to buy the label and include it.

Sellers have the opportunity to require signature with a return label.

Sorry we were wrong, again.
Proof of delivery for returned items
Returns should be sent with tracked shipping that can be independently validated.
We require all of the following to prove a successful return delivery:

Does eBay actually enforce that though? Their return labels don't provide a signature option so if the buyer used an ebay label, I would be surprised if eBay enforced that particular rule.

Proof of delivery for returned items
Returns should be sent with tracked shipping that can be independently validated.We require all of the following to prove a successful return delivery:
- A delivery status of "delivered" or "attempted delivery" (or equivalent in the country to which the item was delivered);
- The date of delivery or attempted delivery;
- The recipient's address, showing at least the city/county or zip code (or international equivalent) that matches the seller's specified return address; and
- Signature confirmation, on items with a total cost of $750 or more. Learn more about our signature confirmation requirements
I guess it depends on the type of case and who pays return shipping.
"When the buyer is responsible for the cost of shipping for a returned item, signature confirmation is required in order to be protected in case the item doesn't make it back to the seller."

My first question @berardi2012 was referenced above:
Did you provide the return shipping label?
Or did the buyer pay for the return shipping label?
If you paid for the return shipping label, then you're out on this one. Seller is responsible for sig conf when they buy the label. eBay return labels don't offer sig conf so you'd have to purchase the label outside of eBay then send it to the buyer.
If the buyer paid for the return label, then you can appeal eBay's decision and reference this policy:
