So I recently received an open box item damaged with clear signs of use and when I went to eBay I got a return with a full refund excepted by the the seller. It’s been almost a week now and I got the refund but I haven’t received a shipping label from eBay or the seller and I feel like there is something fishy going on I dunno what is eBay’s policy on this, do I keep it?

If you were refunded AND not sent a shipping label, the item is yours.

Most likely the seller accepted the return without the need of sending the item back. If goods are damaged as you indicated, why would seller spend more $ for the return label to received damaged inventory that he wont be able to salvage. Bottom line, seller decided to take the loss and moved on. Since you mentioned receiving the refund, you should do the same as well, as in getting rid of the goods, or if can repair them.

Did you look in your spam folder?  When you look at the ad, does it show that a shipping label was sent?  If no, then most likely the seller does not want the item. It's yours to toss.

In many cases the seller just issues a refund and lets the buyer keep the item for free.  That way they don't have to spend even more money to ship it back.  If the seller wanted it back you would have been told by eBay you needed to return it.

You can dispose of it or keep it as you see fit.
