Account has been restricted because activity on it didn't follow Emissions control defeat Policy

Looking for anyone who had had issues with this subject in the past or can chime in with some information.   I received a 3-day restriction because of a second violation, the first violation i was clearly in the wrong but this time the item in question I feel doesn't apply to emissions control devices.  I asked eBay if they could provide me with a detailed list of non-compliant items which they could not.   So, if they can't provide a list then how do they deem what's non-compliant and how am I as a seller supposed to be sure my items will not receive a 3rd violation moving forward?  I used my best judgment the 2nd time around and got restricted and dont want to guess what's compliant and what isn't.   Can ANYONE chime in on this one?

 

This is the message I received today:

Your account has been restricted because activity on it didn't follow our Emissions control defeat devices policy. Products that bypass emission-control systems are not allowed.

eBay does not allow listings for items that are intended to defeat, bypass, or render inoperative emissions control systems. We appreciate that you chose to utilize our site, but we must ask that you please not relist in this case.

You can't relist items we've ended. Please ensure your current and future listings follow this policy.

 

What is the policy

Products that bypass, defeat or render inoperative emission-control systems aren't allowed, either on their own or when combined with other hardware or software. See the EPA Enforcement Alert for more information.

Examples of such products include, but aren't limited to:

- Tuners, services, software or devices that modify the performance of vehicles, such as cars, trucks and off-road vehicles
- Aftermarket standalone (non-OEM) electronic control unit (ECU), including full electronic fuel injection (EFI) conversion kits
- Powertrain or exhaust parts intended for “race only” or “off-road only”
- Active fuel management/Dynamic fuel management or auto start-stop disablers
- Blocking plates for emission control systems
- Products that remove factory catalytic converters (CAT) or diesel particulate filters (DPF), selective catalytic reduction (SCR) and diesel exhaust fluid (DEF)
- Throttle response controllers
- Exhaust servo eliminators
- Devices intended to bypass or reduce flow to oxygen sensors

How this affects your account

Because you haven't followed this policy in the past:
 
- Listings that don't follow this policy have been ended.  
- A temporary 3-day selling restriction has been placed on your account (starting on the date of this notice), and your other listings will be hidden from search during this period.  Listings will automatically be restored and show up in search results after the end of the temporary restriction.
- Any fees paid or payable for listings that are ended and/or hidden from search will not be refunded or otherwise credited to your account. 
 
Listings that don't follow this policy in the future will result in similar actions, including a 7-day restriction on your account.

I've heard and seen this before.

Bottom line is, it doesn't really matter what you "feel".

If ebay decides they want to end the listing, they have every right to do so.

It doesn't matter who is right and who is wrong.

My advice would be, don't sell ANYTHING emissions-related on ebay.

Appreciate your feedback but im looking for someone who may have compiled a list of items that would be for sure considered a voilation against this policy.  I am very aware of certain items but some I would have never guessed it.  And thats just the thing I dont want to guess. I want to be certain.

It is refreshing to see that eBay is protecting its members by regulating what can be sold on the site.

Was this a dirt bike helmet? Used bicycle helmets are not allowed so maybe the bot thought bike and bicycle are the same. New ones can only be sold by eligible sellers. (Eligible means 100 sales in the last year.)
