Refund on an item I can't return

I bought an Apple Watch Ultra, it's supposedly "open box" but it's clear it's been used. Not only that, but the watch arrived Activation Locked. Meaning it can't be activated with a new Apple ID unless the previous Apple ID is removed. The seller told me they don't know who the previous owner is, thus, that is a dead end. Addionally, I tried contacting Apple directly to remove the Activation Lock but they require original receipt with the Serial and other stuff. The seller has been pretty useless in this, as I have had no additional reply other than a screenshot that shows the technical issues of the watch.

 

I don't live in the US, and I can't return the Watch. I've never had any problems with Ebay orders, but this seller is pretty useless. Is there anything I can do in order to get a refund without returning the watch? 

 

Thanks in advance for any advice that you guys can give me.

This is one of the pitfalls of using a freight forwarder in the US - it voids your eBay Money Back Guarantee protections. All of your purchases become "buyer beware" so you have to be extra cautious in vetting the seller and the listing. You may wish to purchase more items that offer eBay International Shipping instead of using a freight forwarder as you'll retain buyer protections.

 

Your only option for the locked watch is to go outside of eBay to your funding source.

I didn’t know that tbh, I checked the listing thoroughly and the reviews were good. 

Nonetheless, their listing itself isn’t true, as it doesn’t specify this and it doesn’t say that is preowned. How would I as a buyer be able to vet this prior to receiving the device?

I'm confused. You're registered as being in the US. Did you change your location in order to be able to make the purchase?

I created the account when I lived in the US. Just change delivery addresses depending on where I can and need to get stuff delivered.
