I went to an ad that had an MP3 player big picture and all that comes with it all the status you know Bluetooth and everything that's why I bought this MP3 player and was sent out a memory card and they say that was the product while I looked on the ad and yeah they offer a memory card in there but the whole ad and everything is around an MP3 player they people are Crooks Crooks

Well now this is a problem:

You did not read before purchase.

As for the photo is does show some thing you did not get, a false advertising and therefore you received an item not as described.

File such against the seller and get your money back after you return the item you received.

Definitely "Not As Described", but I'd ask for a refund and a prepaid return shipping label, since the 'error' was on the seller's part, not the buyer's part.  The seller mislead the buyer and abused the goodwill of eBay in general - they should pony-up for the return shipping (WITH TRACKING!) and give a full refund.  Definitely open the case - and all communications either on eBay Messages or via the Case only.  No regular email.
