Fire Sticks are something like cell phones.. they can be "jailbroken," which to many users increases their value/utility significantly. Amazon may not like this practice, but the law says that's tough. It's not entirely legal in the US to sell a good without actually giving it to your customer. Courts have upheld this position several times in recent years. By Amazon's business model, the Fire Stick is more like a cable box that you rent, remaining under Amazon's control at all times. But they hide this practice by not charging you rent and by giving it a retail price, implying transfer of ownership.
eBay does not enforce user agreements for companies like Amazon or Apple. In fact, they're competitors of Amazon's. Unless it's legitimately illegal to sell something on eBay, they don't have any particular motivation to take action.
I for one am against Amazon's policy on Fire Sticks, and I would encourage eBay members to write their congressmembers and express support of full owners' rights, including right-to-repair and limitations on shrinkwrap licenses. Let Amazon worry about their problems. They wouldn't have this issue if they treated their customers fairly.
