Seller sent false tracking numbers not shipping because value of item increases!

I was wondering what you guys do to someone whom sends tracking numbers that are no good. The reason I ask is I bought a football auto from a seller on 9/10/15 he sent a tracking number on Monday I tried to track Monday night didn't work. I sent him a message he rosponded that the card would be shipped 9/15/15 checked tracking number nothing. Checked the tracking number today nothing so I talked to my postmaster he said it was a bad number. The player on the card played a good game and the card is increasing in value and I thank the seller doesn't want to let it go now. I gave $69 and shipping for the card and it books $200 I fell the seller should have to give a fair value back when this happens or be suspended from ebay. Please let me know how you guys handle these problems because this is a legal contract the seller entered into by law!
