Seller refuses to use Free Matter for the Blind or Handicapped

Under Federal Law 101-336 and US Post office regulation EO40 referenced in this link

https://pe.usps.com/archive/html/dmmarchive20030810/E040.htm under Section 2.1 the following types of materials can be mailed for free to or from eligible persons as stated in Section 1.

 

2.1Acceptable Matter

Subject to 2.2, this matter may be mailed free:

a. [8-8-02] Reading matter in braille or 14-point or larger sightsaving type and musical scores.

b. SOUND REPRODUCTIONS

c. PAPER RECORDS TAPES AND MATERIALS for the production of reading matter, musical scores, or sound reproductions.

d. REPRODUCERS OR PARTS of them for sound reproductions.

e. Braille writers, typewriters, educational or other materials or devices, or parts thereof, used for writing by, or designed or adapted for use of, a blind person or a person who has a physical impairment as described above.

 

Many sellers complain that their post office personnel are ignorant of the Federal Law and accompanying Post Office Federal regulation and further complain that the sales price is ``not worth the bother'' for having to go to a bigger post office with a higher authority that is more likely to be aware of the policy.

 

Many sellers also cancel the order when informed of FMFBH which is also not only against eBay policy but illegal as well.

 

eBay blanket policy requires that all buyers and sellers comply with not only eBay Global corporate policy but also all Federal and State/Provincial laws in the country where business is being done - including the U.S. - making compliance with this Federal law and its' accompanying Post Office policy mandatory.

 

Yet when this condition is reported through Trust and Safety - eBay does nothing about the issue - such as creating a button for Free Matter for the Blind or Handicapped in the Checkout for shipping - instead referring it back between the buyer and the seller themselves - and the Post Office - resulting in a stalemate.

 

That stalemate is exactly why eBay and every other online sales platform needs to add the button - because baseline post office personnel are not only ignorant of the policy - they offer pushback when forced to comply with it - referring to higher and higher authorities which are often all off-site - or referring back to third party call, chat and correspondence centers in foreign countries who have no awareness of the policy at all.

 

However if a package shows up with a pre printed label and all the staff has to do is scan it and put it in a pile - they have no problems.
