Returning a gas powered item

I purchased a brand new generator. Which is our sole source of power. It larger then our so we could run our AC with it. In Nor. Ca its to be 107° today & the generator did not work. Ca law plus the Post Office has told me that I can not send it back through the mail since I added gas & oil. Even if I drain it out, gas flumes are flamble. First they said they could not take it .Take it to honda .So I did & now they say send it back which Ca says I can not. What do I do 107° is not nice in a RV with no AC and no legs.
