so I won an auction, seller refunded my payment and reused to honor the sale

The seller decided that my winning bid was not enough so he just refunded my payment, didnt cancel the order or contact me.

Today I see he has relisted the same item at the same price, probably hoping he will get a better bid.

He is just going screw the next buyer out of the item id he doesnt get the price he wants. This could go on indefinitely I suppose.

Isnt this a violation of the TOS ?

It is a violation of eBay rules, but realistically there's no way eBay can force the seller to complete the sale. The seller will get a defect for cancelling the transaction. If they get enough of those, their selling privileges will be revoked. But all you can do now is leave feedback.
