Purchased item mailed after case opened

I purchased an item on 4/8.  They printed the label on 4/8 but never mailed it.  I waited until the expected delivery date.  Sent several messages to the seller asking if it had been mailed.  I never received a reply.  On 4/18 I filed the "never received item."  Ebay said they would step in on 4/24 if no action.  I requested a refund.  On 4/25 ebay put my case on hold until 5/4 since the seller decided to mail it on 4/25 but never sent any messages.  I no longer want the item.  Do I have any options?
