Paid item figures as unpaid

Hi!  

So I won the bidding for a couple of shoe stands from a seller that I later realized had no feedback.  I paid anyway and my order figured as paid for about 5 days before I asked when will they ship the product.  They said it's the Chinese New Year and they cannot send packages (although it wasn't specified the seller is away)  and wether I want a refund.  I asked for a refund and haven't heard from them for a while.  I told them I  would open a case with eBay and they promised again to refund me immediately.  It has been a few days again and it seems I can't open a case because my purchase figures as unpaid,  although in the purchase menu it appears as paid. 

What should I do?  Thank you!
