Lost return.

I bought a comic for $41. When the comic arived it was damged, nothing close to what was pictured. I did a return and the item disappeared. It made it all the way back to local post office of the seller. Now I dont have the comic or the money. Pretty sure Ive been conned.  Is there some place on ebay I can follow up on this? The return request has just been sitting there for weeks and the comic has been showing shipped but not moving.
