Is this fair?

Paid 13 $ for this pallette when i got it the pallette smelled like poo and there were so many duplicate colors and it just comes off within 5mins  i contact the seller and they say send pictures and they will email the manufacturer and give me refund  so i sent pics and they tell me they wanna refund 3$ out of the 13 is that fair?  Then my guitar person the guitar  i paid 35$ wont stayed tuned more then 1-2 mins, has multiple chips, if i pay 35$ for a guitar i want no chips! But the person tells me how about i refund 10$ for compensation  for something i paid 35$ for and is useless, is that fair also?
