How can eBay side with a scammer!?

I got scammed and feel silly for it. However, I figured eBay would make it right. Boy was I wrong. I opened an item not received case and it was almost immediately closed in favor of the seller because there was tracking that showed it was "delivered". Turns out, this is a large Vietnamese scam ring that provides fake tracking numbers and simply runs with your money. What the hell gives? How can customers possibly prevent being scammed like this? There was no indication by looking at their profile that they were a scam by the way. No neg feedback when I purchased my item. Now, their feedback as of today is miserable due to a whole week's worth of feedback from others who have been scammed. eBay needs to make this right. Period. Myself and many others are being told to basically just deal with it because some phony tracking said "delivered". Why even use eBay? I may as well take my chances and just order from any dark corner of the internet with Rock bottom prices. I'd have the same buyer protection apparently.
