Didn't receive an item - seller resend - still didn't get it - now i can't claim my money back

Hi,

Can some1 help me how to solve this situation:

I ordered item before 3+ months. After 1 month I contact seller with info I didn't received it and we agree that he resend new item.

As i report it to eBay I picked option that we found resolution (shipping again) and I put note that item is resend and to give me one more month so if I don't get it I can claim my money back. My case was closed automaticly.

Now is 6 weeks passed from last contact from seller and I still didn't get my item (he said it would need 6 weeks to get to me).

Ebay don't give me any option to report this case - so what to do? On end I can't even give bad rating to seller 😞
