Hello, I've never used this forum/or had to in 20 years but wondered what my rights are as a buyer if I bought something that had a name brand on it but when I received it I found it was not the actual real brand, simply a counterfeit copy yet I paid a substantial price for it thinking it was a closeout. Now I find it's a cheap copy. The seller is in China and says I have 30 days to get my money back yet it took a month to get to me and I don't believe I should have to pay return shipping...Just wondered what the norm is on this type of issue. Thx in advance!

@valerierussak Brand name items + China equals counterfeit 99% of the time.
You have 30 calendar days after the estimated or actual delivery date or within the seller's stated returns window, whichever is longer.
The seller pays return shipping by sending the funds for shipping to your PayPal account BEFORE you return the item. You must return it using Priority Mail or you will not have tracking to prove delivery.
Select the return item button on this page: https://www.ebay.com/help/buying/returns-refunds/returning-item?id=4041
4 business days after filing the return request if the seller has not provided a return shipping label OR sent the funds to your PayPal account to pay return shipping if they are in another country then ask ebay to step in and help: https://www.ebay.com/help/buying/returns-refunds/ask-ebay-to-step-in?id=4701
2 business days after tracking shows delivery back to the seller the eBay system will automatically refund you if the seller has not already done so.
If you have to purchase a label at the post office with the funds that the seller provided be sure to upload the tracking number into the case. The tracking number is your proof of delivery.
Returns to China or other countries that do not have 1st class delivery confirmation MUST be shipped Priority Mail.

I've already submitted my claim but it says on the listing that buyer pays return shipping. I'll be waiting for some reply but hopefully ebay will take this into consideration and make the seller pay for everything. It's a motorcycle helmet that has a name brand on it but it's not the name brand. Even the DOT certification is not correct according the real company. I'd hate to see what would happen to this noggin protector if it actually hit the street. Sorry people out there these days! Thanks for taking your time to help me!

@valerierussak Buyer pays return shipping is for remorse returns only. Wrong size etc. This is a not as described item so the eBay Money Back Guarantee over rules that.

Great, that is logical..hopefully it will not be an issue..although I believe the seller is a crook so I'm not holding my breathe. Thx again!
