Seller is not shipping, item lost- must i wait until after delivery date for a refund?

I purchased an item, the sellet waited a week to say can i cancel the payment, the item is lost, will not be shipped. Ebay wont let me request a refund until after the anticipate delivery date... do i have to wait? Can i do something else?
