If they don't have the item, they should cancel the order as out of stock and refund.
If they don't:
A day after the estimated delivery date Ebay gave you, open an Item Not Received case.
Go to your purchase history and click I didn't get it in the menu next to the item.
The seller will have 3 days to provide a tracking number showing it was delivered or refund.
If they don't, return to the case on day 4 and ask Ebay to step in.

The moniker you mentioned is a seller. Are you the buyer a pair of those pants?
If the seller has asked if they can cancel your order (since they're out-of-stock), then they just want to know if that is okay with you. Sellers must take Out of Stock cancellation strikes and it sounds like your seller is trying to avoid one.
For either reason (you requested/seller approved or OOS), you'll receive a full refund.
