Seller gave me a tracking number but never shipped the item

I would appreciate any insight as I seem to be going in circles with Ebay. The seller gave me a tracking number and told me I would have the item two weeks ago. Here is the tracking info from the USPS  website 

Pre-Shipment

Shipping Label Created, USPS Awaiting Item

PITTSBURGH, PA 15235 

I have asked for a refund but

I can't seem to get anywhere with Ebay because they say that the item has been shipped.  The seller continues to tell me the item is on its way and he doesn't give refunds on items already shipped. 

I'm not sure if I have any recourse through Ebay.

Did you file an Item Not Received complaint with eBay?

You have recourse once it has passed the expected delivery date. Once that date has passed you can open an item not received case. The expected delivery date should show on the item if you look in your purchase history.
