Why are ANY Dvd's being allowed to be sold when it's wrong to do so.

With all these copyright laws and things, why is Ebay allowing ANY dvd to be sold on here when each dvd says on the back "For Private Use Only"... So when you sell any dvd, aren't you violating and infringing on the copyright of the movie and distribution rights of the Studio who released it? Isn't that called "piracy"?? Here's a thought...get rid of the entire category of movies, dvd's, vhs, records, laser disc and all others and not allow any of these to be sold Ebay?huh?  Explain to me about this "Fair Use" thing I've heard talked about when you don't have the right to sell ANY movie and make money for yourself? Inquiring minds wanna know Ebay.

You are misunderstanding COPYright law.

Home use DVDs are marked that way because it is a copyright violation to broadcast or show the content in a commercial or public setting (Like a Bar for instance)

 

You are perfectly entitled to sell unwanted DVDs second hand, just like it is perfectly legal for DVD shops to sell DVDs market that way new in the first place. Technically speaking, anything you buy Retail in a shop 'new' has been 'Owned' by at least 3 other companies before you got hold of it.

 

What is illegal is to make a copy of a DVD and sell either the copy or the original while retaining the copy.

The physical disk is what you purchase and own when you buy a DVD. The media on the disk is what  does NOT belong to you, and you have no rights to that portion other than to play and watch it yourself. But it can be transferred in a one- time sale as the original disk.

 

you CAN sell that disk as you would anything else you have purchased and  owned, that is your only right.  You just can’t profit by showing the media, copying it, or otherwise infringing on the copyright of the media owner. 


it really isn’t that confusing.

Canada is a socialist country leaning towards comunist.

US is a democratic country leaning toward socialist.

 

We are at different points on the scale, and laws reflect that.

I've seen books with that 'cant be resold' stamped on it, and sold them anyway because (so far) this is a free enough country that I can sell most things that I own.

 

Hey Marno ... can you sell your used Ford truck?  Or do you have to scrap it when you don't need it any more ...

'Can't be resold' is not meant for an individual who purchases/receives that item. It is aimed at the distributors of the item-- for example, when I worked at GameStop, we would receive preorder bonus items that were meant to be given out to people who preordered copies of a particular game. They were all marked "Not for resale" because WE, GameStop, were not allowed to sell them as they were items specifically intended to be given out for free with a purchase. If the people who received those items with their copy of the game wanted to then turn around and sell them, that was perfectly fine.

We don’t have Fords in Canada.  Fords are products of scummy capitalist countries.  We drive old Ladas and Yugos made before the USSR collapsed.  But we don’t own them; King Charles does.  As head of state, his mother Queen Elizabeth distributed them to families in an ambitious program started in the early 80s.  But plans to replace them every five years collapsed when the Soviet Union imploded, so now we have to keep these vehicles going much like Cubans do with theirs.

 

Charles is okay with Canadians trading cars, at least.
