Vape gear rules not enforced for all.

I listed 2 vape mods and eBay wrote me and said they deleted them. They said that vape gear isnt allowed. No mods, ecigs, cig alikes, egos, atomizers, rdas, no eliquid, even zero nicotine. OK fine, I get it. But what I dont get is why there are thousands of other vape related items listed. Items that have sold and items again relisted. For 2 weeks now I've been watching thousands of vape auctions get listed. I randomly reported a few various priced vape auctions and they didnt delete them. What is this favoritism?

ebay tobacco policy says u can list items intended for use with tobacco(pipes,waterpipes,hookahs,etc). SO....why can u sell tobacco related products that are intended for use with tobacco but not vape devices intended for use with eliquid with and or WITHOUT even nicotine in it?

It can be frustrating when you see other sellers listing what your listing was pulled for, but when listing, don't go by other listings.  Check the Restricted Items List.

in restricted tobacco items ebay refers u to fda site with a link to their site.. FDA says all u have to do is check photo id(which ebay should implement this in their system), no sell to 18 or younger, and state a health warning statement on the product .

and why the heck doesn't ebay just implement an age verification at check out for everyone. This is what the online vape shops do. and they don't make near the amount of money ebay does.

All right, Jason -- eBay has hundreds of thousands/millions of sales per day.  I'd really like to know how eBay could actually verify the ages for just the sales of tobacco-related products, much less the age of every buyer on eBay. 

 

Bill's On-Line Bait, Beer, Porn, and Vape Shop can try to verify the ages of on-line buyers, but they're selling a miniscule volume compared to eBay.

 

Years ago the local ABC affiliate here (Atlanta) did an experiment which was later televised.  They chose four children between 10 and 12 who were computer literate (my son was one of the four).  Each signed on to a different web site advertising cigarettes by the carton.  Each ordered eight to ten cartons.  Each checked a box or something on the order agreeing that they were old enough to buy cigarettes.  Each paid with a parent's credit card (with our permission, but they could just have easily "borrowed" a card from their mom's wallet).

 

All four children received the cartons of cigarettes they ordered, delivered to their homes.

 

The four on-line outlets were contacted by the TV station for their comments.  Three said that it shouldn't have happened.  One didn't answer.  The story, almost five minutes long, ran on local TV news and was picked up nationally.

 

Other than it's vape stuff rather than cigarettes, why would this story be any different today?

Vape Mods are now allowed, and you have to be an authorized seller on eBay

I do not plan to sale vapes here on eBay (I did my research and I don't want to lose my account) But it makes me believe there some favoritism or something out there because I keep getting email adverts relating to vapes by eBay and I believe that for those kinds of adverts you have to pay. Also like many of you have pointed out their tobacco policies need to be worded out better.

Yes, there are some exceptions for items that don't contain any tobacco, such as collectible packaging, promotional materials and memorabilia. Smoking accessories that are traditionally intended for smoking tobacco products are allowed. Please read our full policy guidelines for all the details on which products are allowed.

 

 Vape mods are just accessories and not related to tobacco products the shouldnt be affected by this policy unless they make one including them.

The person who said that the answer is, there are Ebay employees (who have the 'clout' to get peoples' listings pulled & repremanded) who ARE sellers themselves, and either they or their cohorts sell all they want and go untouched, is 100% correct. Watch any of the "how to ship" videos Ebay posts: "Hi, I'm Amber....an Ebay employee, but I'm ALSO a seller too....and here's how I package (blah, blah)". If it looks like *it, smells like *it, feels like *it, and tastes like *it...then it's a good thing you didn't step in it. I've been selling eliquid on here (with another user name) for 5 years (never with ONE drop of nicotine in any of it) and my listings have been pulled plenty of times. I've also been 'restricted' despite Ebay and PayPal making about $350 a month off me on a regular basis. THERE IS NO LAW, NOR CAN ANYONE LEGALLY PROSECUTE YOU (nor are stupid enough to try) FOR SELLING ANYONE FLAVORED VEGETABLE GLYCERINE. That's ALL that eliquid is, except for the nicotine in it....which "IS" tobacco, and should be regulated. Eliquid minus the nicotine is a FOOD product. There is nothing found in it you can't buy all day separately, or at a grocery store, or can't bake in a cake and sell all day long without anyone batting an eye. My listings don't even say that the product is for vaping, nor does it even state that it's "e-liquid" or "ejuice"....plus, they always clearly state: "you must be 18 to buy our products". Which brings us to the next MAJOR issue, and indicator of serious internal corruption (which I've pointed out to a couple of people who have purchased from me)....YOU MUST BE 18 to buy ANYTHING on Ebay, and IT IS AN EXPLICIT VIOLATION OF THE USER AGREEMENT EVERY ONE OF US HAS TO SIGN to do so. Therefore any parent who files a complaint that their non-adult child did ANYTHING on Ebay, needs to be blown off and informed that the little creep falsified information to even be on there (which is a legal offense, prosicutible by Law), so therefore, their complaint is moot and the transaction, therefore criminal....not Ebay's, NOR their partner's (seller's) problem. Further, people under 18 are not legally allowed to use PayPal, because minors cannot be legally held responsible for financial information, transactions, etc, and cannot own credit cards of their own accord. And I believe that's Federal Law. Ebay and PayPal BOTH know this goes on every single day and they do nothing about it.....when CCs dispute the transaction, they simply pay it and make YOU (the seller....who the crime was technically perpetrataed against in these cases) jump through all the hoops and take THE TIME to dig up "support info". I don't know about you, but I run a business and the first rule is: "Time IS Money". So they vicariously are screwing you there too. It seems to me, for the 20%+ that EB/PP get off every nickel you/me/every other seller transacts....we should be protected from the violators. Their accounts should be removed ON THE SPOT and all claims associated with said, be disavowed......and as Mr Ebay said at the first of this "blah, blah......don't make another account or penalties would be more severe". And that doesn't even begin to address what their other partner, USPS, who's raised their price on a 1 oz package (and modified the definition thereof - 'package') 500% over the last 5 or 6 years, is taking in off the business. Anyhow....the end answer is this: Our entire system is corrupt, from the ground up, and Ebay is no different. There should be a DEEP investigation into everything that is talked about in this thread, because it's ALL technically criminal. THIS IS America....we're all supposed to be treated the same and the Law is supposed to work the same for everyone.....not just special people. And I hate to tell you this, but these rules are especially explicit when it comes to trade in this country; what goes on is pretty much the same type of thing as insider trading, stock manipulation, etc. And per what the other user said....I am personally waiting to see that "Class Action suit" that covers this **bleep**....I will definitely be first in line. They've cost me literally 10s of K in lost revinue, and no telling how much else.

It may be a particular type of vape that you were trying to sell. If you type the word vape int he search box 75,000 vapes are in the search results. Most of them being complete vape units. If Ebay had a problem with this they would simply spend half an hour to write a program to remove all listings with reference to vape

I never understood how other sellers could compete with the manufacturers themselves.  Just within the past few months, I finally got sold on dry herb vaporizors as much more efficient than smoke; and was able to buy for a very reasonable price direct from Arizer, a nifty little handheld unit that has more than paid for itself already.

 

Add to that a nonexpiring coupon for $15 off my next purchase from them (may eventually splurge on a tabletop unit like the Volcano), there just seems to be no reason to buy from anyone other than direct (though a local dealer could carve out a niche for convenience of course).

If it works, sell it. If it works well, sell it for more. If it doesn't work, quadruple the price and sell it as an antique.
