Batman Damned #2 will be released on 11/21/2018. Some of ebay sellers are posting it now which is in violation of your sellers terms.

If I do it I will be kicked off. These people have been preselling things over 2 months before their release date and nothing.

There is a report button on every listing.  Just follow the prompts.

If you think a listing is in violation, report it.

Exactly.

Some continue to fly under the radar and others will immediately get caught and their accounts suspended.

It is like real life.  You do something illegal until you are caught.

All I can say is do not look to what others sellers are doing, just follow ebay's rules.  Because one day their luck will run ouut.

I can empathize with you on this. Police officers cannot catch every speeder on the highway. Only one will be caught while the others get away with it. The same applies to sellers on ebay. Not every seller will get caught. 

Just because there are others listed, doesn't mean you can also.
