Can you sell HARDWARE (not software) modded consoles and games?

I understand having a hacked console that has unauthentic games on there software is against TOS, but what about authentic hardware modded consoles? For example a Gameboy Advance with a ISP display or shell that did not come with the original device? What about modifying the motherboard or shell or label of a Gameboy game? Is it safe to assume I can sell modded stuff so long as the mods are hardware and not software? I would appreciate any answers, thanks!

There are a lot of refurbished iPods on eBay, where people take out the original drives and replace them with CF or micro SD cards, replace the backplates and screens, etc. I'm not sure how often this happens with GBAs but it's basically the same concept.

 

I would contact eBay directly to make sure, but you're probably okay to list them as long as your descriptions are extremely clear about what has been done to each item.
