Packaged Arrived but missing item (Shipping package tampered)

Good afternoon all,

For some context, I recently ordered 2 items from the same seller (snowboarding gear). I have no issues with the first transaction (Jacket) and the item arrived perfectly packaged and sealed. However, when I purchased the second item (Pants) it came in a box where it looks beaten up and tampered with. When it first arrived I verified with my RING that the mailman leaving it on my porch. I went to pick up the package and without opening the package I was able to quickly indicate that the pants were missing.

This rarely happens since I do have frequent packages coming to the house and items are placed in my porch box container for items so they are safe when delivered.

What are my options on this matter to get a refund or my money back for item I paid but missing through transit or being tampered while being shipped to me? I have reached out to the buyer but in their for sale post they don't accept refunds. Is there something I can do on my end or I am out of luck?

@nightkid08.  You can provide the seller pictures of the package to file a postal insurance claim. 

 You are covered by the eBay Money Back Guarantee. This overrides the sellers no returns policy  

You have 30 days from date of delivery to file an item not as described refund request on eBay.

Missing parts or pieces Since you didn't order an empty package.    

4 business days after filing the return request if the seller has not provided a return shipping label OR sent the funds to your PayPal account to pay return shipping if they are in another country then ask eBay to step in and help:

If you have to purchase a label at the post office with the funds that the seller provided be sure to upload the tracking number into the case. The tracking number is your proof of delivery.
Returns to countries that do not have 1st class delivery confirmation MUST be shipped Priority Mail.
