Item listed as Very Good condition, but arrived in less than that.

I purchased this item which is listed as in Very Good condition, but it arrived in poor condition, with the disc full of sticky grime on the face side and deep scratches on the readable that have rendered it useless and unplayable. Normally, I'd ask for a refund, but in this case the description provided by the seller talks about "no returns" and "sold as-is" with a very vague description of the disc, if any at all.

Does this put me in a position where I'm not entitled to a refund?
