CBD POLICY IS NOT CONSISTENT..POTENTIAL LIABILITY UNEQUAL TREATMENT..

I called eBay described my plan on listing RAW CBD flowers legal in all USA states and within framework of the Agricultural Act of 2018. I did not offer sales outside of the country. I offered this product for people to make their own oils from the raw material. They gave me a go and I listed and invested some money getting started. Things went great and then they de-listed item.

 

They said it is not legal in whole world and that "bad actors" people might smoke it. The listing does not allow buyers from anywhere but where it is legal. On the "bad actor" argument If they use the standard of what a person might do then shouldn't knives or bats be banned following same logic? I mean someone might use the knife to stab or a bat to hit another person. We can apply this logic to many other items.

 

When pointing this out they changed subject and stated non consumable items are allowed. I brought up the fact that the topical items are being consumed via the skin. This is how CBD works. It is absorbed into the skin when applied - so people are consuming it if applied topically. 

 

Finally, they are allowing items Oils which clearly indicate consuming by mouth. 

 

eBay needs to open the flood gates to this legal product in any form available and not treat the USA customer base as children. If a seller can prove that they are conforming to the LAW ( Agricultural Act of 2018) they should allow sales in any form. OR, they need to eliminate all forms.

Time for a class action lawsuit if they treat people differently. Hundreds of CBD flower products and other consumable oil products. Hiding behind we can't enforce everything is not an excuse. They either need an approval process for those acting legal and clear guidelines or cut it all out.

Ebay receives a ton of negative press for what is allowed here. For example porn and nude items for sale and in the wrong category has turned off many. While I have no ill feelings towards CBD I do not think it is best to list on this site and it is possible that the government may intervene.

 

So for an example - I am not a fan of buyers having to weed (no pun intended) through postings of Vibrators, XXX action, bongs, bowls, and sex trafficking before they reach my baseball card listing. Just saying - My opinion. In order to be a world class organization you need to have values and I question the values allowing some products on this site. While they may be legal, it paints a picture of a company that will sell its sole for a profit.

Don't kid yourself, the above process ends up costing ebay and that cost is ultimately passed right back on to sellers... It will be tough to find a team of lawyers that will even want to take on your case since they all know ebay has their own team they must go up against, then they may end up asking you to front up the money which could end up costing you as well and then there is still no guarantee you would win...

All lessons in life cost money, some are expensive.

 

No, there has to be a better way than this American tradition of burning weeds to the ground like a punishment.

One thing I have learned is don't play with fringe items.

eBay faces no potential liability for unequal treatment. You agreed to unequal treatment when you agreed to sell here. From the user agreement:

 

"we reserve the right to refuse or terminate all or part of our Services to anyone for any reason at our discretion"
